WILSON, (United Press Staff Correspondent.) Washington. Nov. 16. The mighty contest for control of the Supreme Court which wracked the nation in spectacular political dispute ended quietly today in a hospital room where Associate Justice Pierce Butler died two hours before dawn. He was the last but one of the conservative justices who challenged the New Deal.

His death after an illness ot almost three months creates a fifth Supreme Court vacancy within fewer than three years. When Mr. Roosevelt places Justice Butler's successor on the high bench he will have named an absolute majority of the Supreme Court and New Deal philosophy will be entrenched there for at least a generation to come. Lacking an opportunity to nominate a single associate justice in his first term, Mr. Roosevelt will name five In his second, matching the record of Abraham Lincoln.

William Howard Taft named six men to the Supreme Court. It is likely that the president will seek a Catholic to succeed Butler, who was a member of that faith, and speculation centered immediately on Attorney General Frank Murphy. The State Superior Court, in an opinion by Judge Jesse E. B. Cunningham, cited as a reason for upholding quashing of an indictment against former State Highways Secretary Roy E. Brownmiller the mt-nner in which grand jury witnesses were sworn. The opinion put on record the court's reason for its Sept.

29 decision affirming the quashing of the Indictments by the Luzerne county court. Brownmiller now is at liberty under bail pending his appeal from a sentence of one year in jail and a $3,000 fine on conviction of having padded State payrolls. The conviction was In Dauphin county, and the proceedings against Brownmiller in Luzerne county were distinct from those at Harrisiburg. District Attorney Leon Schwartz sought to bring to trial In Luzerne county, Brownmiller, Wm. J.

Carroll, a district engineer in the Highways Department, and John Con-Ion, superintendent of State Highways in Luzerne county. Indictments were obtained against the trio on charges of "grossly excessive overdrafts of the funds allot-ed for State highway purposes in Luzerne county" and the "submission and passing for payment" of fraudulent payrolls.
