WASHINGTON Dec 9 (IP) Navy scientists reported day that the failure of the Van guard satellite rocket last riday was due to mechani cal failure in the propulsion The Office of Naval Research issued a three paragraph state ment on the misfiring which led to a world wide wave of criti cism and prompted President Eisenhower to demand an of ficial report The statement did not pin point exactly where the failure occurred in the gleaming 72 foot rocket It said such details were labeled secret presumably on security grounds But a Defense spokesman said a full report had been sent to the President by March 15 unless the Bakery Workers conduct an immediate clean up campaign The committee asked the con vention to give the AL CIO Executive Council the power to determine the date of expulsion and to pass on the effectiveness of the clean up In a last minute insert in its report on the Bakers the com mittee asked for expulsion un less the union takes steps "to "bar from international union office City yesterday admitted it did not have suf ficient evidence to convict the Royal Nevada Hotel on the Las Vegas strip of cheating at 21 The decision ended a three day slow moving hearing at which the Las Vegas operators had been ordered to show cause why their gambling license should not be revoked on eight charges including cheat ing An undercover agent testified at the hearing he had seen cheating on two occasions at the plush casino last August Richardson of Las Vegas the principal owner immediately ordered the casino closed following the decision The hotel however will remain open Richardson confirmed the ca sino did not have enough money to continue operation The hotel admitted it was guilty at least partially of four of the eight counts lodged against it by the board It said yj essence it had failed to keep enough money on hand and had violated Other rules and regula tions of the gaming board and 1 the state tax commission Not Considered The other three charges were not considered There was no testimony on any of them al though the board made it plain it reserved the right to prose cute the hotel on any of them at a later date The end of the hearing did not mean the gambling license would not be revoked The gaming control board still must make a recommendation to the tax 'commission which has final say in gambling mat ters The tax commission meets Dec 20 Richardson and his attorney Thomas oley declared inves ors were willing to pump new money into the strip resort if it was cleared of the cheating charge Recoup Investment oley who wept when the de cision on the cheating charge was announced had pleaded with the board to permit owners to recoup the $900000 they have invested in the hotel He said no amount of money could keep the hotel in operation as long as the cheating charge existed Two years ago employes at the Royal Nevada fearing they would not be paid raided the tables scooping up all the money in sight oley said this was what Consider State Evidencet Tribunal Rules WASHINGTON Dec 9 The Supreme Court ruled unanimously today that wiretap information ob tained by state officers under state law is inadmissaole as evidence in criminal trials in federal courts The decision may have an important bearing on the current federal prosecution of Teamster official James Hoffa on perjury charges The New York trial Jias been held up pending a decision by the high court on the wiretap issue Attorney Paul Williams of New York had intended to offer wire tap evidence against Hoffa ob tained through the office of State District Attorney rank Hogan in Manhattan Paradoxically Hoffa currently is being tried in Nejv York on charges of violating federal anti wiretap laws by phones in the Teamsters Union's Detroit headquarters Permitted by Law A New York State law per mits high law enforcement offi cers to tap telephones and to use the evidence obtained in criminal trials in state courts The high decision had no direct bearing on the use of wiretap evidence in state trials In a separate decision it also ruled that information obtained by listening in on a telephone conversation on an extension is admissible even in federal trials But in throwing out wire tap evidence in federal courts the court noted that Section 605 of the ederal Communications Act specifically forbids anyone to intercept telephone conver sations through wire taps ine Distinction As a result the justices sent back to the federal court in New York for further proceedings the case of Salvatore 'Benanti He was convicted in federal court ol violating federal bootlegging laws on the basis of wire tap evidence obtained by the New York police His conviction was upheld last May by the Circuit Court of Ap peals It held the evidence was admissible inasmuch as no fed eral officer participated' in the wire tapping Benanti drew an 18 month prison sentence The high court stopped short of ruling on the constitutionality of state wire tap laws But Warren noted that the federal law applied to both interstate and intrastate telephone com munications The court drew a fine distinc tion between wire tapping and eavesdropping in upholding the conviction of loyd Linn Rath bun of Albuquerque NM on charges of transmitting a threat to kill in interstate commerce His trial featured evidence ob tained by two eavesdroppers who listened in on extensions while Rathbun was talking on the phone In its 7 to 2 decision the high court agreed that it was not il legal to listen in on an extension without the consent of the caller and then to
