High Court Revenue Code Quirk Upheld in Ruling WASHINGTON May 27 The Supreme Court refused today to shorten the jail sentences of gambler rank Costello Binion of Las Vegas and others who challenged a Post Office Department mon ey bill today with a warning that mail service will have to be starting Juty 1' unless Con gress votes the department more funds if not thousands of small post offices throughout the as well as cut back other mail services The Senate and House knocked 58 million dollars out of the Post Office budget for next fiscal year to show they in the economy drive But the postal chief said that far from accepting such a cut his department will need 140 million dollars more just to maintain present services Summerfield said that he would request the sum a few He warned at the time the cuts were made that he would have to curtail postal services July 1 un less the reductions were restored and another 70 million to 90 mil lion dollars appropriated Even if Congress PRESS tax commission hold ing it was pointless to pursue the matter further yesterday voted against further disciplinary action against Marion Hicks and former Lt Gov Clifford Jones licensees in the Thunderbird Hotel gam bling casino The decision ended a two and a half year legal battle in which Jones and Hicks successfully fought a commission order 25 months ago revoking their licenses on grounds they had permitted Eastern underworld figures to hold secret interests in the hotel's casino Nothing to Gain Commissioner Robert A Allen declared nothing would be gained by carrying the question further Walter Larsh another member of the commission said he believed the commission would appear if it took further revocation action against the two men The commission ordered their licenses revoked in April 1955 making the order effective June 1 1955 Hicks and Jones subs quently obtained a temporary re straining order from District Judge Merwyn Brown in Win nemucca blocking the commission from enforcing the revocation Brown subsequently granted the hotel a permanent injunction in Las Vegas against the com mission's order The tax commission appealed ruling to the supreme court holding that the law the district courts were not au thorized to issue injunctions or restraining orders in gambling matters Not Sufficient Earlier this month tire su preme court ruled the commission did not have sufficient evidence to support its major accusations against Jones and Hicks The court said however other accusa tions appeared to be well founded and perhaps the commission would take further action against the pair The court also agreed with the tax commission contention that the courts were not authorized to issue temporary restraining or ders or preliminary injunctions to block the commission from en forcing its orders Gov Charles Russell who also favored dropping the matter said we get this out of the way the better off going to He added that while the commission had "lost the battle we won the Up to Commission randsen Loomis commis sion legal adviser who announced his resignation at the conclusion of the session discussed the meaning of the decision for 90 minutes He told commissioners the court had said in effect that it could take action against Jones and Hicks on some of the accusa tions of the original revocation order in your lap you can do anything you want to Loomis said He said the courts after study ing the record before the commis sion on revocation actions could grant a permanent injunction pre venting enforcement of the
