He said he Interpreted a Texas Attorney General's Office opinion to mean the judge could be authorized by the Court to sell the lots. Steen conducts Sheriff's Office delinquent tax sales ol property In this county. He said that $5 was an acceptable price for any of the lots but not less than $5. Wednesday The Facts called Steen In Austin, and was told that the only time the 11 lots put up for tax sale was In 1894-95 when the City of Quln- twia acquired them, He said he had not put the lots up for sale In any tax sales he has held here, The lots were sold to the City of ulntana because no one else bought them, and they have now come under county control, he said, The county can sell the lots and divide the proceeds between the county and school district, he said. He said the reason he said the lots should not sell for less than $5 was because that was the opening bid on them at the early day tax sale.

That was the value placed on them, he said, but al a sheriff's sale, an opening bid of any amount can be set. The judge can sell them to anyone who offers $5 or more for them, said Steen. He said Montgomery and Exline had contacted him about the lots, but Girouard had noj. A Facts source with knowledge of beach-area real estate said that sales were too few In Quintana to establish a firm value on lots there. The opinion of this source, however, was that open-to-the- publlc bidding would probably have resulted in substantially higher bids.

Some of the lots appeared to be In a position to be of use now, The Facts was told. In a check of the Tax Office book, a Facts reporter could find no listing for Lot 4, Block 41, which according to the ulntana map Is on Fuller Street between Fourth and Fifth, The other 10 lots are listed. Lot 1, Block 118C, was listed In Cora Alice Perry's name until 1939, and has been listed as "owner unknown" from 1959 to 1967, with taxes delinquent for that period. This lot Is (or was) located on the Gulf of Mexico between 13th and 14th and Kastl Street. Some lots are reported to be under water.

Lot 3, Block 134C, was listed as exempt. The lot Is on the Gulf of Mexico between 15th and 16th and Gulf Street, In the delinquent tax books, only Lot 1, Block 118 was listed as tax delinquent from 1939 to 1964. This delinquent tax book carries notations for property that has been put up for tax sales. None of the lots had such notations. The blocks are made upof 12 lots each, or six each facing on named rather than streets.

The other lot locations are: Block 21, Lot 8, on facing James between Second, Third and Bastrop. Block 47, Lot 9, on Lamar between Fourth, Fifth and Burnett.
