JEWS FURNISH HIGH COMEDY POLICE COMMISSION ENJOYS HEARTY LAUGH Pool Room Case Proves Barrels of Fun Japanese to Hear Decision at Next Meeting "Sure I taut he was a regular un, he crime around every night," said Samuel Moshenberger to the police commission last night In testifying In regard, to the pool room at 319-21 Kant First street. The Jap 1 bet on( don't stand no show In the world and I 101 my forty in about three minutes. "It doesn't seem good to me and I makes a big holler to the cop, he ain't got no uniform but ho's a cop all right because I saw the Jap cashier give him a handful of cigars, and the cop Bays, 'Begone, Samuel, you ain't got no more case than a Sure I alnt got a case. I didn't give him no cigars." Wants to Eject Japanese The trouble that started the controversy In which Mr. Moshenberger engaged last night originated In the de- Sire of R. L.

Bennett, owner of the building at 319-21 East First street, to eject the Japanese owners of the pool room and put in a wholesale liquor store. The liquor store would have paid much better rental than the pool room. Incidentally, but Bennett said he nothing for that. Bailey, who served as attorney for Bennett, had four witnesses who said that the pool room was disorderly, that fights occurred almost continually, that gambling was carried on and that liquor was sold without a license. The witnesses who appeared for the Bennett side of the case were: William Goldforb stated that he had played pool for 25 cents a game In the hall at 3 19-21, and that the Japanese took a cut of 5 cents when money was played for.

He also testified that he had a drink In the telephone booth, and that a friend bought it. Rozln stated that he had also piayed pool in the place for money, and that It had made a confirmed gambler of him. In fact, the habit of betting which he acquired In the place had ruined him. He told the commission how he bought William Goldforb a drink in the telephone booth and paid 2 0 cents for It. Commission Laughs The commission was not Inclined to take Rozin's ruin very seriously; in fact he was unfeelingly laughed at when he told of his downfall.

Harry Lyons, the owner of a wholesale and retail women's clothing establishment on the floor above the pool room, also testified as to the place. He said It was a nuisance, but declined to specify how; H. Davis, owner of a bakeshop in the roar of the pool room, testified that if he did not watch his employes carefully they would climb over the fence which he built and go and play pool. He said this was nuisance to him. Mr.

Davis said: "I go to work and pay out $25 to build a high fence to keep my men from going over In that pool room and still they climb over and go play pool. I have to watch them close, and it ain't good for me." R. J. Scherer, attorney for the Japanese owners of the pool room, also had four witnesses. These said, that no liquor was ever sold in the place, that there were never any fights, that lt was not a disorderly pool room and that there was never any gambling.

8 Isadore Roth, a cigar dealer, was the first witness for the defense. Ho said: "I goes often by the pool room and sells them Japs cigars. I ain't never seen no rough If I seen lt I wouldn't stay. For why should I mix up In rough house? "Sometimes when I takes the Japs their cigars I sets around and watches 'em play pool and I never seen a nickel bet on a fame. There ain't been any whisky sold In the place as far as I knows, and I would prob'ly know." Not Worse Than Others Black asserted that he frequented the pool room that he saw no trouble and Ellis B.

Cohn said much the same. G. W. Carson, the first witness called, not of Yiddish blood, told the commission that he had a store across the street' and that he never saw anything wrong with the pool room beyond 'an occasional fight. Captain Flaimner of the police department told i the commission that while every pool room the city caused the police department work he had investigated the character of this Japanese pool room and had found nothing particularly wrong with It.

For the mayor and the members of the commission the trial was fun and from each of the- Jews as they appeared. on the stand comedy was extracted.
