Tho case of Lau King and Chung Hoy will go to the Circuit Court of Appeals In Han Francisco. These young Chinese claimed to be born In Honolulu and attempted to effect a landing hero some weeks ago. District Judge Esteo refused a landing, and added that ho would not accept the testimony of Chinese witnesses If unsupported by whlto testimony In that case or any similar cases. The lads were returned to China. Tho ruling of Judge Estee that he would not accept Chinese testimony us of tlto same value as other testimony has created no end of comment among attorneys and tho Chinese colony has taken serious cognizance of it.

The attorneys claim that It Is next to Impossible to obtain white testimony as to the birth or residence of Chinese, us the races do not Intermingle to an extent making such possible; nnd that If Chinese testimony is not to be relied upon it Is useless for uny Hawulian Chinaman to attempt a return to this country. Lorrin Andrews, attorney for the two Chinese boys mentioned, yesterday filed In Judge Estee's courts an appeal tu the case of Chung Hoy on a writ of error. This will be a test case. A decision In It will decide both ns they are Identical. A further trouble confronted Chinese in the United States district court, however, and will have an effect upon the two cases referred to.

It Is the recent ruling of the treasury department that Hawaiian Chinese are not citizens and can not pass to the mainland of the United States. Many people imngtned this was merely a department ruling and probably would not be sustained by the Attorney-General. Chinese were foremost in this belief. It seems, however, that the solicitor of the treasury department, who presented the opinion, is a representative of the Attorney-General and that the opinion was overlooked and npproved by Attorney-General Griggs before being submitted. On that account It will be used as an official guide In Judge Estee's court In future In Chinese admission cases.

DR. RAYMOND PRESIDENT. Work of Yesterday's Meeting of Board of Health. At tho meeting of tho Board of Health yesterday afternoon Dr. J.

H. Raymond was unanimously elected president and entered at once upon his duties. The Noblitt mutter was threshed out to a finish with the result that a petition for reinstatement was flatly and llnully denied. Attorney General Dole stated that ho would vigorously prosecute Noblitt If he attempted to practice again without a license. The proposal for new steamer service between Honolulu and the Molokal settlement was tabled, leaving the contract still In the hands of the Wilder Steamship Company.

Davics Company were awarded the contract for 20,000 pounds of canned meats for the settlement. Mr. Reynolds was authorized to construct new buildings at the settlement at a cost of $2,200. A report of Attorney General Dole, with regulations prohibiting the importation of fire arms and liquor into tho lepef settlement, was adopted. Both are now sent In packages of freight by friends of the diseased.

Dr. Sandow, of Kauai, was granted a leave of absence until February and Dr. Goodhue will net In his stead until he returns. Dr. Sandow will marry In California, Miss Elston, sister of Charles A.

Elston. A motion was passed appropriating a sufficient sum, until the legislature meets, for new sewers. This will be $100 or $500 a month. Relief camps on Punchbowl and Vineyard streets were ordered closed. Various sanitary matters were discussed and disposed of.

REPUBLICANS DECLINE. The Republican Central Committee has formally replied to the Invitation of the Independent Home Rulers for a Join committee to formulate municipal legislation. The invitation -Is declined. Just what the Democrats will do their own party leaders seem not to know. It is understood that Colonel McCarthy, chairman of the central committee, opposes going In with the Independents, believing that the party Is amply competent to act alone.

On the other hand, Mr. McClanahan. chairman of the late campaign commute: John Wise, Prince David and others appear to favor cooperation. CORONER'S JURY ACTS. Tho coroner's Jury appointed to Investigate the death of Thomas N.

Mltchelf yesterday returned the following verdict: That said Thomas NIau Mitchell came to his death at Honolulu, Island of Oahu on December 11, 1900 from drinking methylated spirits or wood alcohol, In such quantity thereby causing acute poisoning and heart failure. The Jury In this case desire further to call to tho attention of the Board of Health the advisability of requiring those dealing in methylated spirits to treat the same us a deadly poison, label the same as such and In all respects conform to the law regarding "Deadly Poisons." See chapter 88, Penal Laws 1897. AMERICA'S GREAT GIFT TO INDIA. NEW YORK, December 5. It Is estimated that more than $1,000,000 has been sent to India from the United States for the help of the famine and plague sufferers.

The New York committee, which disbanded today, raised $272,888. NOTICE.
