Settlemyer, Mrs. Molly Settlemyer and Link Settlemyer to appear before the Mayor In bis court room at 10 o'clock a. m. to answer to the charge of retailing liquor. The parties were present and "the case called.

The defendants asked for a continuous on account of the absence of their attorneys, which was granted until 3 o'clock p. m. Promptly at 3 p. m. the court convened, the defendands and their attorneys, Butler and Osborne, were present, and the trial of the case was at once commenced.

City Attorney J. C. Jefferies appeared for the city. A number of witness were sworn, and as is usual in such cases, their statements were rather grudgingly made. The court adjoined at 5 clock p.

m. till 9 o'clock a. m. Tuesday when it promptly convined. The evidence all being in, the attorneys for both sides made able arguments.

These one and two horse farmers compose a large per cent of our best citizens and those of them who have had the foresight to buy lands, in addition to being independent, are fast forging to the front as oppulent and influential citizens.

We long to see the time when all of our good, hardworking "people will be tilling their own land. A Model Ginnery. A LEDGEitTepresentative was shown through the model ginnery of T. G. McCraw a few weeks ago and was surprised to find in our midst such a complete establishment.

The whiskey was in six beautiful jugs and carefully packed in a box and marked "cina-retts," but the accidental breaking of one of the jugs revealed the nature of the contents of the "cigarette" box and caused the chief to fasten his official clutches on the "cigarette" box, jugs and whiskey. A New Citizen. Herod Neale, late of York county, has moved to Gaffney. Mr. Neale was a member of Co.

Palmetto Sharpshooters, in the Confederate war, and lost a leg in the battle of Seven Pines. He was for a long time public auctioneer of York county, and conducted all the public sales. He says his got to be a very poor business, as a county that raises its own bread don't have many big land sales, and York does that. We welcome Mr. Neale.

Death of a Well Known Colored Man Uncle Strap Littlejohn, an old and respectable colored man of this city, died Monday afternoon. Uncle Strap belonged to one of tho numerous Littlejohn families on Pacolet River, before the war. He was a faithful slave, has conducted himself uprightly as a freeman and therefore has always had friends among the white people who knew him. Settlement. Comptroller General Durham was in the city Saturday and settled with Treasurer Jones and the other officials of Cherokee county.

M. Uttmmohn. Oct, JO-ilt, Executors, myer and Link Settlemyer gumyas charsed sentenced each one of them to thirty days, or $100 dollars. A. to pay a fine of Settlemyer was discharged.

The attorneys for the defense as once gave notice of appealed from the Mayor's decision to the full council and tho time wa3 set for yesterday morning at 9 o'clock a. m. When the case was called for trial Mr. Jefferies for the town took exception to Messrs. Butler Osborne's notice of appeal.

Mr. Butler appearing for the Settlemyers, took issue with him and the Mayor overruled Mr. Butler's position and forced him to trial on the question of jurisdiction altogether, which hadjbeen raised the day before, then the only question for tho full council to do was to pass on the question of jurisdiction, nd it was quite novel, xur. uuuir claimed that the ordinance under which the defendants were held was of no effect, null and void, and that the Mayor had no jurisdiction and asseu the fu'l cour.c.l to reverse him in ssuming jurisdiction. After hear- ng argument from Mr.

Butler for the defendants, and Mr. Jefferies for tha town, the full council unanimously reversed the Mayor and the defendants were discharged, ine question was a novel one in that Mr. Butler took the posic.on uiut nasmuch us the charter of the town did not confer on the council power to pass un ordinance against the sale linuor thev could not ao so, re lying on the decision of Judge Benet and the decision of the supreme court in the case of city council of Florence vs. Biown, and the charters were almost identically the same The supreme court in that case with a divided court, sustained Julge Benet. and the defendant wa3 dis charged.

This is quite a new and nteresting question and knocKS out the town council from trying any one for selling liquor until a new or dinance against same is enacted. This is rtuite a victory for Messrs.
