The suit Instituted Davis was the outcome of sales of property made years ago by the now defunct Oakland Prospect Homestead Association, of which plaintiff's now deceased, was one of the principal owners and a director. Title to the property was left in a complicated tangle when the corporation -went out of business, almost forty years ago, and as time wore on the individual-owners ceased to have it cleared. About six months ago Davis appeared in court with his suit, claiming the property after having fenced it in without warning, on the ground that he was the holder of tax titles and as claimant by heritage through his father's interest in the Oakland Prospect Homestead Association.

At the conclusion of yesterday's proceedings Davis gave notice of appeal from the nonsuit entered by Judge Harris. LOS ANGELES, Aug. 31. The East Midway district is showing much activity, with the Pyramid oil company and the Honolulu Consolidated as the largest operators. On sections 18, 20 and 30-32-25 the Pyramid oil company has erected in all ten derricks.

Well No. 1 has been started on section 18 and has now reached a depth of several hundred feet. A circulation has been installed In order to cope with the water sand. On section 20 a complete rotary drilling outfit is being installed. A complete rotary rig has been installed on section 30 and drilling will be under way in a few days.

On section 24-32-24. the Honolulu Consolidated has reached a depth of approximately 2000 feet. On section 4 the Honolulu Consolidated has Just brought In a well at a depth of 2700 feet that produces from 400 to 500 barrels a day. The gas pressure is sufficient to cause the oil to flow by heads. WORK IN GUSHER BELT.

Both these companies are also operating in the gusher belt of North Midway. The Honolulu Consolidated is perforating well No. 1 on the Hawaiian property, which was drilled into the sand with a rotary and Superintendent Pollard expects it to come In as a splendid producer. No. 2, which was brought it as a gusher some time ago, is pumping and flowing at the usual rate.

Other wells are drilling on this property. On section 26-31-22, farther to the northwest, the Pyramid has reached a depth of about 1200 feet. The first oil sand was encountered at 1055 feet, but this was drilled through and will be cased off.
