Klinwlnc the Amount Pntil In by thu Various Counties In tho Stare tndor the Scott Law Tjnt Venr Irefc Comitieuui Cincinnati Om Oct 50 Tho gentleman who has been acting as the attorney for tho saloon beepers over since tho litigation in regard to thu Pond and Scott laws commenced is probably the bust posted nmu on this subject Iu tho city and ho Is very much elated over the triumph of his clients A Commercial Gazetto reporter found him busily engaged in straightening out his otfico affairs preparatory to tho work of bringing tho numerous suits which tho decision of tho Supremo Court will entail He was asked in regard to tho inception and history of tho litigation und said substantially In 1SS2 tho first law relating toa tax on tho liquor traffic was passed by tho Legislature April 5 and became generally known as tho Pond Law this name being given it bocauso of tho introduction by Dr Pond Tho Pond Law provided for a tax hi cUe of the first class of 300 and was graded to suit tho smaller cities and towns of tho State aown to 100 which was tho lowest tax imposed 300 being the highest This law in addition to the assessment of tho tux also required the giving of a bond lor tho faithful performance of tho requirements of tho act to be approved by the Probate Judge and in addition to this tax and bond a ixmuliy was attached for violation of from -500 to 81000 or imprisonment for from not exceeding one year to not loss than thirty days This law created great dissatisfaction and tested by what is known as tho Hipp in which tho Supreme Court of the tate hold by a decision of four to one nidges MacIIvaino White Long worth and Okey assenting and Judge Johnson dissenting that the law was unconstituloiiaL This court held that the Pond law as passed was not a license law and therefore under the constitution of the Stuto of Ohio could not prevail Tho following winter tho law introdued by Dr Scott commonly called tho Scott law was passed April 17 1882 by tho Legislature This act provided for horizontal tax of 200 Dn all places in which Intoxicating beverages wero sold but where beer and wine were lold a tax of 6100 only was imposed There was a provision iu this law that tho person renting tho proporty on which the liquor was Jlspensed should have tho consent of thu landlord for the use of tho premises for the purpose of selling intoxicating liquors a Talluro to obtain such consent for the salo of mch liquors being declared a misdemeanor nd punishable accordingly In this respect tho Scott Law was similar to the Pond Law tho first providing that a bond should bo given for the payment of tho nx tho second that the consent of the landlord to the bale of tho liquors should bo ol ydned Jletween the date of the decision on the Pond Law tested and decided in the Hipp ase and tho time that tho Scott Law cases ame up the personnel of tuo Supremo Court jad undergone a change Judge Whiio hav tog died aud Judge Longworth bavin re iignedand Governor Foster being any tt iawcame up for onsideration befoiv Supremo Court Judges Follett Doyle Mcllvaine Okey and Johnson on tho bench in what is now known is tho Frame case and after a lengthy argument tho law as passed was upheld by the Supremo Court as then constituted four ol he judges Johnson Mcllvaine Upson and Doyle deciding it was constitutional Judge Dkey dissenting and ujKjn tho strength this decision the liquor dealers amo forward very reluctantly and paid he money under protest Prior to this lecisioii King of this city brought sut igulust tho Auditor and Treasurer of tho city Cincinnati to enjoin the assessment of this ax and the creation of this lion upon the property and ulso for an injunction to re itrain tho Treasurer from collecting tho tas This cosu was held back until after tho decls on in the Frame case when the injunction was refused I was attorney for King i ror was prayed iu the District Court and a sro forma alllrmance of tho judgment beiow tvas agreed to an exception taken and tno rdpr was filed in tho Supreme Court for eavo to file a petition In error to tho judgment of tho District Court Iu the meantime the el wt had been add and Judges Uon und Doylo wero defeated aud Judges Fohettand Owens elected The motion for leuve to file jetition in error nas argued and submitted to the Supreme Court aud was granted last April Petition ji error was filed und cases were sot for hearing April 27 On May 17 the King case together with tho Iluutzmann cu of Clove Umd were argued and submitted to the Su pr me Court and the constitutionality of tho law dlscued On tho 17th of June the main question presented for review both the King aud Buntzmann cases was argued md the Court held that tho clause in the law fronting a Hon upon tho property was uucon ititutlotial leaving tho other questions as to the constitutionality of the law for future llscussion and since that time until the piesont the cobcs remained in statu quo In response to further questions the attor aoy continued Tho other casos Vero brought and tie question in whole was presented to the Su premo Court last Tuesday In four of five different forms Ono was a prayer for an Up junction to restrain tho collection of the tax and also a suit or the recovery of the money paid under tho law within tho year These two cuses came from Franklin fjbunty Another case was a mandamus from Miami County to compel the Treasurer collect tho money Another case was from Clove- land to enjoin tho collection of the tax and ulso a case from this county brought by fjlmilea A Miller as Treasurer ta recover the tax and judgment hi tho latter case had gone agutnst the salooulst and the question presented tu the Supremo Court was with reference to ttils judgment so that the Scott law has been presented to tho Supromo Court In every conceivable und possible form that could arise The Supreme Court ha now decided that the law isUnconstltutlonal which necessarily settles tho whole dispute and I dont anticipate any chango in tho Supreme Court for tho next two years unless death or resignation should intervone Tho attorney further raid that his clients wie willing to pay a legal tax but tho State cm not legally tax a suloon keeper except by bt nw and they had been living nnder this construction of tho law sinco the passage of tho act in 1851 schedule IS and they claim rdso that the Scott law as passed was In cmi illct with Section 2 Artlclo of tho Consti tutlon of 1851 which provides for a tax on moneys rrwlft oto according to ite true value in money What amount has been paid in by the saloon keoiKsrs and what amount Is recoverable was asked by the reporter Well wo think wo can recover out of the 400000 paid in in this county about M0f 000 as claims for this amount have been made within tho year as provided by Sectlou 68 iS of the Revised Statutes which affords litigants tho remedy by injunction to restrain the illegal levy and collection of any tax and also to give thorn tho right to recover taxes illegally paid Bofore tho passage of this act they wore compelled to go into a Justicos Court to bring bult for any amount under 100 Tho section referred to given them tho right to go into the Superior Court or Court of Common Pleas to recover any amount and tho remedy to recover by Injunction did not exist until the passage of this act Well then tho saloon Ists who have paid tho tax audwho havo not made claim within the year as prescribed by law cau not recover asked tho reporter No sir sai 1 ho they can not and the amount eo paid in is about 100010 As I said wo can recover about 120000 Cincinnati Township Hamilton County Ohio plaintiff vs Charles A Miller Treasuier of Hamilton Comity Ohio defendant Bill of particulars Defendant is indebted to plaintiff in tho sum of dollars money had and received by defendant June 1SSJ to tho uso ol plaintitf for illegal taxes paid by plaintiff under protest by virtue of tho Scott Law which is unconstitutional for which sum plaintiff pays judgment with interest and costs 4 Attorney for Plaintiff1 For tho retail dealers who sook to recover a petition is filed of which tho lauguago in Couut of Common Pleah Hamilton County plaintiff vs Charles A Miller Treasurer Hamilton County Ohio defendant Petition Plaintiff says that ho is engaged in trafficking in iatoxioating liquors in Hamilton County Ohio and was bo engaged In tho year 18S PJuiutiff in compliance with the act of the nerai Assembly passed April 17 188t eu an Act further providing against dls resulting from tho traffic in intox liquors made duo statement of sail to the proper Assessor who ro tA ue Mime to the Auditor of said coun a by him was placed upon a duplicate ua oviiloJ by said law for that purpose ii plaintiff assossod In tho sum of dol lars that a copy of said duplicate was turned over to tho defendant as Treasurer aforesaid for the purp so of collecting said assessment which amount tho plaintiff on the day of 18J paid to said urer for which payment plaintiff holds his receipt Plaintiff further sayH that said asscssmont and collection wan wrong oppressive ami illegal aud that in making such statement and In tho payment of such assessment tho plaintiff did so under protest to avoid tho tmvy penalties of tho law and ths annoy a ice and trouble tnat would arise from refusing to comply with the demand of tho Assessor for a statement and of thu Treasurer for tho tuyuunt of tho assessment Whereforo plaintiff prays judgment igahistt tho defendant Charles A Miller Treasurer of Hamilton County Ohio for the mm of dodars with inter net fmm day of 18SJ and cost of suit herein Attorney for Plaintiff Stat of Ohio Hamilton County ss 1 above named plaintiff makes oath and says tho statements in tho foregoing petition uro true and he verily is substantially the samo with tho exception that we aver they aro not dealers within tho meaning of tho law and that they uro distillers rectifiers and manufacturer from raw material and do not couu within tho bounds of tho Scott Law and wo claim the rotnil men are entitled to recover on tho ground that this law iu its effect was a license and it wa3 a license because It creato I a Hen and required tho consent of the property owner boforo the promises could be used for tho sale of intoxicants The Supreme Court havo decided that tho law a license and it could bo enforced as a license and it was a violation of a sectlbn of tho Consti tion which says that all proporty must be taxod a uniform rate in accordance with its truo niondy valuo There were two grounds In tho argument It was either a license or It was not a license then it was In violation of tho very boctlon quotod that a uniform tax should bo assessed on all proporty Section 68 18 says Courts of Common Pleas and Superior Courts Bball have jurisdiction to enjoin the illegal levy of taxes and assessments or tho collection of either npd all actions to recover back Buch taxes without regard to amount shall bo had within one year after such taxes or assessments havo been collected Consequently it would follow that no recovery can bo had by these men who havo paid their money under protest unless suit was brought within a year aftor its payment and payments as a rule wero all made prior to tho 1st of July 181 and the last day of tho legal period of recovery would consequently be the BULLE Mast day of July 1884 consequently suite brought aftor tho latter date can not be upheld nnditho men can not recover How many suits within the year havo boon brought and ou which tho parties aro entitled by law to recover Well about six hundred in all of which I oti tho legal representative and on these we Bball be able to collect about 120000 This gentlomar if the suits aro successful will havo realized the largest foe ever paid to any member of tho bar of this county and tho approximate amount of his feo is estimated ut 75000 although it Is rumored a leading hw fir ai of this city will also have a portion if tut Ire Comments Cincinnati Oct 80 Tho Enquirer Democratic commenting upon tho decision editorially says Tho Supremo Court of Ohio has decided the Scott law unconstitutional This disposes ut a question which has boon discussed for several ywirs and which has entered largely into pontics ibo ronu law imposing special taxation on the liquor traillc was loclarod unconstitutional Thon it was rovisod and re enacted and from tho fact that it was Introduced in the House by Dr Scott of Warren County became known as tho Scott law It In fact however owed its paternity to Governor Foster and his advisers and tho belief that tho Supremo Court at that time was in the hands of the champioiiH of tho bill pushed it through both branches of the Legislature by a very narrow margin Timo bus worked change and In spit of the action of tho Court as formerly constituted throo of tho five Judges at present ou tho bench have declared the law nulh Tl ground of tho dfcisIon is set forth in our amnio dispatches from Columbus Tho unbiased non partisan opinion of many of the ablest lawyers iu the Stato has long boon in accord with tho view taken by a majority of tho Court yesterday vanoui opinions are current as to tho effect of tho decision en jttlltlcs but that is not the main consideration The action of tho Court comes after the election for State olllcers Whatever influence it may havo on tho coming Presidential contest in Ohio remains to le een It will bo easier to dotennlue that matter a few days hence The Commercial a Republican paper says editorially Tho decision of tho Supremo Court deciding the Scott Law unconstitutional is tin last kick and tho most fatal of tho Democratic party This is tho most disgraceful act ever ierforuied by tho Supreme Court of Ohio iu tho history of that tribunal It re- 3ulred a tremendous effort to prevail upon udgo Owens to agree with his two Democratic colleagues to unite in that decision but it was finally accomplished and freo liquor is tho result It is tho last stroke on the part of the Doinocratlc managers in their vain effort to cany tho election It is a bid for tho German vote and it is foolishly supposed that Germans have no principle above or outside free ilquor It is further foolishly supposed that men wno pny taxes upon their homes aro in favor of exempting persons engaged in th liquor traillc from tho burdens that fall upon other people in sustaining the State county and municipal governments It Is also to be remarked thut ot all the saloon keeiwrs or tho half of them aro opposed to tho Scott tax These understand their business and are iu favor of a tax sucb as was imposed under the Soott law iVhat Is the effect of this decision It strikes two millioi dollars annually from tho retail liquor traffic and plicesit upon the real and personal pro erty of the pooplo upon their homes and iioir ir lustrlea In Cincinnati and Hamilton Couuy it wipes out a revenue of four hun hod thousand dollars per annum which must bo made up by increased taxation It depletes tho treasury of nearly every municipal corporation in Ohio In Cincinnati by reosou of tho non payment of tho Scott tax polico and other city officials liavo not been jiaid a dollar since the 1st of June and the inmate of the City Infirmary are on the point of be ing turned out of doors to encounter the harshiiis of winter To make even our depleted treasury will requlro a loan of ono million and half of dollars The tux ha already been increased from two per cent under Republican management to two and three quarters under Democratic control and now to xnuke up for tho falling off in the revenue from tboScott tax and tho refunding ot those taxes paid under protest our next lovy will bo over three per cent in nduititm to an Increase in tho debt of one million and a half This is what comes from a Democratic administration a Democratic Su premo Court and a Democratic Governor wiio cares more for a vote for Cleveland thin he does for the interest of tax payers or the purity of tho Judiciary we now tuni to tho people of Ohio and ask thorn what their answer will bo to a decision that falls heavily upon overy tax payei and especially upon those who llvo in municipalities Wo turn to our Germau fellow-citizens who pay increased taxes uton their homes iu order that tho liquor traffic may bo free We turn to responsiblo
