staff writers Hours before funeral began Thursday night for Rep John Duncan a federal appeals court in Cincinnati threw out the tax-charge conviction of son and an accountant The three-judge panel of the 6th US Circuit Court of Appeals ruled 2-1 that Joe Duncan and Michael Downing are entitled to new trials on a single count stemming from the filing of Joe Duncan's 1982 federal income tax return
