Appeal Ruling on TV Channel 7 Three television stations, including South Central owner of WTVK-TV. Knoxville, have asked the U. S. of Appeals to study an FCC refusal to order the reassignment of very high frequency Channel 7 from Spartanburg, C. to Knoxville, Columbia, S.

and Augusta, Associlated Press reported from Washington. Spartan, Broadcasting owner of WSPA-TV at Spartanburg, yesterday was granted temporary authority to go on the Channel 7, and announced it is ready to begin regular programs tomorrow. It went on the air Thursday. Petitioners UHF Stations WTVK-TV is an ultra high quency station, as are the other two petitioners, WAIM-TV, Anderson, S. owned by Wilton E.

Hall, and WGVL-TV, Greenville, S. owned by Greenville Television Co. They also asked the court to study an FCC order permitting Spartan to operate its Mountain instead of Hogback transmitter from atop to Paris Mountain. They further seek review of the FCC denial of their petition for a stay of authorization to Spartan pending commission determination of the merits of the proposal for reassignment of VHF Channel 7. Last year, Mr.

Hall of WAIMTV, Anderson, asked FCC to switch Channel 7 from Spartanburg to Knoxville and Columbia or to Knoxville and Augusta. His petition was denied. Compares Size of Cities He said the transfer would result "in more fair, efficient and equitable distribution of the available frequencies than its present assignment to Spartanburg for the single reason that two cities, each larger than Spartanburg, would be able to use the channel." The petitioners said Spartanburg is a much smaller city than either Columbia, Knoxville or Augusta, which, they added, the FCC itself has stated is a substantial determining factor in channel assignment. The petition also stated the commission itself has recognized "the impossibility of survival of UHF stations in markets where they must meet VHF competition and the virtually universal recognition of this fact in the entire television industry." The proposed transfer of Channel 7 would make possible more effective competition among the states of South Carolina, North Carolina, Tennessee and Georgia, the petition said. She wore a waltz-length dress of yellow taffeta and lace and carried a Colonial bouquet of spring ers. The groom's father was best man, and Roger Allen, cousin of the bride, was usher.
