RESOLUTION WHEREAS: It is the desire of the Kossuth County Board of Supervisors to modify a portion of Kossuth County's FM-FASSe- condary Road system and, WHEREAS: The following reasons are given for said modification as noted below: (1) Proposed modification relocates part of FM-FAS ROUTE 70, Kossuth County from a present gravel surfaced road carrying only 17-45 VPD to a present bituminous surfaced road carrying 142-220 VPD, and (2) Proposed relocation is consistent with Trunk Road Classification of the County Roads of 1970. (3) With above relocation of FM-FAS 70, FM-FAS 1170 from SW Corner Section 36-96-30 North 3 miles to NW Corner Section 24-96-30 can be deleted from FM-FAS system due to its proximity to the newly located FM-FAS 1170. NOW THEREFORE BE IT RESOLVED: The Board of Supervisors of Kossuth County, Iowa, on this 22 day of March, 1971, request the Iowa State Highway Commission to make the following modifications in the. Farm to Market (FM) road system/ and that the Commission request the Federal Highway Administration and/or the Bureau of Public Roads as to the applicable changes in the Federal Aid Secondary (FAS) road system. Delete from the Farm to Market and Federal Aid Secondary , Road System the following described sections of road: (I) A portion of Federal Aid , Secondary Route Number 70 beginning at the Southwest Corner . of,Section 34-96-30 and inte^- y secting with U., S. Primaryjjighr way Number 18, then<?e North for approximately 9,0 miles and there intersecting with>ederal Aid Secondary. Route Numbsr 67 at the Northwest" corner of Section 22-97-30. (2) A portion of FM-FAS Route Number 1170 from Southwest Corner of Section 36-96-30 and Intersecting with U. S. Primary Number 18, thence North approximately 3.0 miles at the Northwest Corner of Section 24-96-30 and Intersecting with FM-FAS Route Number 1139. ADD to the Farm to Market and Federal Aid Secondary system the following described section of road: (3) Beginning at U. S. Primary Highway No. 18 at the Southwest Corner of Section 35-96-30, thence North approximately 9.0 miles and there intersecting with Federal Aid Secondary Route Number 67 at the Northwest Corner of Section 23-97-30. RESOLUTION WHEREAS; Proper and I^egal notices and publications were served and published according to the Code of Iowa, and, WHEREAS; There were no objections filed in writing with the Kossuth County Auditor and, WHEREAS; A public hearing was held in the Court House, Algona, Iowa, at 10:00 A.M. (CST) on March 22,1971, and. WHEREAS; Thees Schnakenberg, an abutting property owner objected to receiving 2 Acres of useless land for taxation purpose along the North line of the NW 1/4 of Section 6-94-27, NOW THEREFORE BE IT RESOLVED: That upon the sale of the North thirty-three (33.0) feet of the NW 1/4 Section 6-94-27 by Thees Schnakenberg and Rachael Schnakenberg (husband and wife) to Kossuth County by Quit Claim Deed, that \ IT IS HEREBY ORDERED, by the Kossuth County Board of Supervisors that the portion of the qrlginally established Road No. ^17 below described be vacated for road purposes, to w|tj From the Northwest Corner of Section 6, Township 84 North, Range 27 West of the 5th P.M., Kossuth County, lowaj thence East one (1.00) mile to the Northeast Corner of said Section 697-27. Resolution adopted the 1st day of April, 1971. (CST), March 22, 1971, NOW THEREFORE IT IS ORDERED: That the following described portion of Kossuth County, Iowa, road be officially vacated: That portion of road from the Southwest corner of Section 25, Township 94 North, Range 28 West of the 5th P.M., Kossuth County, lowaj thence North one (1.00) mile to the Northwest Corner of Said Section 25-94-28 of the 5th P.M. Resolution adopted this 1st day of April, 1971. RESOLUTION WHEREAS: Proper and Legal notices were served and published according to the Code of Iowa and, WHEREAS: There were no objections filed in writing with the Kossuth County Auditor and, WHEREAS: The only objectors present at the public hearing held In the Court House, Algona, Iowa, at 10:00 A.M. (CST) on March 22, 1971, were Ambrose Lickteig and members of his immediate family and, WHEREAS: The Lickteig objection was' that said proposed vacation denied the Lickteig farm home and buildings access ,to a public' road and, WHEREAS: Ambrosa Lickteig ag«?ed to' doMte'a strip of land 40jtf feet wide along the • South edge of the Northeast quarter of Section 14, Township 96 North, Range 28 West of the 5th P.M., Kossuth County, Iowa; said 40.0 feet width to begin at the North- South Center of Section line of Section 14-96-28 and continue East parallel to the South line of Said Northeast Quarter of Section 14-96-28 for 2310 feet. Donation of this strip of land is specifically for the purpose to permit the Kossuth County Board of. Supervisors to establish a public road. NOW THEREFORE IT IS ORDERED: That the following described portion of Kossuth County Road, No. 45 be officially vacated: •\ That portion of originally established Road No. 45 from the West quarter corner of Section 13, Township 96 North, Range. &8 West of the 5th P.M., Kossuth Ctwnty/Iowa; thence North one and one-half (1 1/2) miles on the West lines of Sections 13 and Section 12 to the Northwest Corner of Section 12, Township 96 North, Range 28 West of the 5th P.Mi This road exists on record only. BE IT FURTHER ORDERED: That the following described parcel of land be established as part of the Kossuth County, Iowa, Local Sec. Road System: Beginning at the Center of Section 14, Township 96 North, Range 28 West of the 5th P.M.; thence East on the East and West center of Section line for 2310 feet; thence Northerly 40.0 feet; thence West parallel to the center of Section line for 2310 feet; thence South 40.0 feet to the point of beginning.
