institution three months ago was arrested Tuesday by Maryland state police in Frederick Md Robert Berkheimer 25 a former Williamsport resident will be returned to Centre County to face charges according to State College state police Maryland state police acting on a tip from Williamsport city police department apprehended Mr Berkheimer and a Williamsport woman in a stolen vehicle according Times SUN Writer The quality of the water near Red Moshannon Creek is the "same as it waa 10 years Rush Township residents were told recently by the state Department of Environmental Resources Township residents had feared that industrial waste from the Moshannon Valley Sanitary Landfill was leeching into the swampy area that flows into Red Moshannon Creek Although the water is not used for human consumption residents were concerned about the possibility of increased pollution in the landfill area and requested that the water be analyzed Industrial waste is not stored at the landfill However Dan Spadoni community relations coordinator for regional office in Williamsport said that there is always a possibility of covert dumping John Varner James McDonald and Bryce Putnam of DER said the drainage that flows out of pipes built into the hill below the landfill is acid mine drainage The acid mine drainage in the landfill area is the result of old deep and strip mining operations said Township Chairman John A Shannon The Bureau of Mining Reclamation in Harrisburg explained that there are no health problems directly caused by the drainage No traces of industrial waste were found in the water supply The DER representatives said the acid mine drainage does not enter the water supply Residents do not use the water from the swampy area and Red Moshannon Creek The Keystone Water Co supplies water for Rush Township from Cold Stream Run and Trout Run DER brought an analysis of water from the swampy area that showed the water quality is the as it was 10 years ago" said Nancy Rishel township secretary The analysis does not mean that the water quality is good but that it has remained unchanged since a study dime in 1974 Mr Spadoni said DER wanted put the minds of the 8th By CHRISTOPHER FITZGERALD lime Staff Writer A federal sex discrimination investigation of Penn State may be reopened along with 18 other cases which were closed last March The US Department of Office of Civil Rights had been looking into Penn State's refusal to grant varsity status to the women's soccer club Penn State was notified in March that the department was closing its files on the case because of a ruling by the US Supreme Court Now several women's and educational groups have filed suit against the department saying the department acted too quickly to stop the Title IX investigations Title IX prohibits sex discrimination in programs which receive federal funding The activity comes in the wake of the Supreme Court's Grove City ruling of Feb 28 The court said the government could not restrict all of a school's federal funding if sex discrimination is found in only one area Thus the department closed the soccer club investigation because Penn State's athletic department does not receive federal funds The suit asks the department to take three basic steps according to attorney Sally Goldfarb of the National Law Center: It should stop closing cases until it clarifies what criteria must be met based on the Grove City decision it should issue a policy which makes the criteria dear It should reconsider the cases it has already closed Filed more than three yean ago the soccer club investigation has been "very dormant" according to Steve A Garban Penn State senior vice president for finance and operations "We've had no communications on this for a couple of yean" he said adding that the univenity also has not been informed of the potential for reopening the case Penn State contends that it cannot afford to give the club varsity status The university has likewise dropped several other teams from varsity to club status within the last few years to cut costs Varsity teams have paid coaches and can compete in numerous tournaments closed to clubs The women who filed the discrimination charges have since graduated but there is still interest in varsity status among current club members according to Vance McCullough director of the sports club program basically operates as a varsity team although the coaches are all Mr McCullough said The club mostly plays teams from other schools which have varsity status and has done very well he added certainly been in contention as the best team in the The biggest reason for wanting to be a varsity team is that the club is now able to get into championship Mr McCullough said A spokesman for the
