Lay Is Latest Entrant In Superintendent Race feel pressured by the Aug 5 court meeting to make a recommendation On the other hand Barnes said his interpretation of a state statute is that the county court must name a successor to Spivey at the next regular or called meeting Barnes said he took this to mean a new school superintendent must come out of the Aug 5 meeting As debate over these two points continue it hardly seems to matter to either the school board or the education committee that Lays application was not received in time Myers said the education committee which is still receiving applications until 5 pm Friday will take up Lays application along with the others Barnes said he passed along copies of Lays application just as he did all the rest Lay said he decided to run because of community pressure A lot of people came to me asking me to run the former assistant superintendent of Kingsport schools said Lay who taught and worked in administration for 34 years is' currently serving his second term as alderman As it did once before this may cause a conflict Lay gave up his job as assistant superintendent in 1972 after the Supreme Court refused to hear his appeal on a suit involving his contract with the city There is a provision in the Kingsport city chapter forbidding any city official from having a contract with the city Lay was forced to choose between his two jobs and chose the post of alderman Lay said he isnt sure if he will have to resign his aldermanic posi- tion if he is elected superintendent The school board meets tonight to select a candidate to recommend to the county court But even that may be in dispute since the education committee says it has the only power to make such a recommendation Barnes said the school board may have no legal power to make such a recommendation but the school board is derelict in its duty if it does not do so Myers said he hoped the board would come before the education committee and present the recommendation first Then the committee will take this into consideration when making its own recommendation at the Monday evening meeting The two bodies are also in discord over when such a recommendation must be presented to the county court Myers said such a decision was too important to be rushed into and the education committee would not the state attorney generals opinion all candidates must be considered Luther Icenhour county attorney said he received an opinion on a state statute The attorney general said he felt all candidates should be considered Icenhour pointed out however that this is only an opinion and is not legally binding Barnes said he felt Don Ward the boards attorney was not of the same opinion and would offer different advice Attorney Richard Currie speaking for Ward said Wards opinion was not diametrically opposed to the state attorney generals but questioned several areas the attorney general didnt consider There is nothing legal and binding about the opinion Currie said It has never been challenged in court And it will be up to the board of education to determine which interpretation it wants to take Leonard Fugate assistant magistrate said he will resign as magistrate if he gets the school appointment The education committee has also received applicants from as far away as San Francisco said Jim Myers a member of the Development Project concentrated its work crews and machinery this week on Oak Street where new storm severs have been installed and curbing and gutteirng are being completed Smith NDP director said anchoring systems but business around Kingsport depends a lot on whether local government is willing to require the tie-downs So far there is no sign that it is Wallace Pardue the Sullivan County Civil Defense Director endorses the idea but there has been no move by any county official to make it law And thought Kingsport City Manager Charles Marsh also thinks anchoring is a good idea city Times-News Staff Writer Last March Jesse Mise a structural engineer started wholesaling anchoring systems for mobile homes Business was slow until last April when high winds blew mobile homes off their foundations all over Hawkins and Sullivan Counties Now business has picked up though only a tiny fraction of mobile homes in the Kingsport area are tied down Mise says that he has sold about 50 tiedown kits in the Kingsport area A month or two after the windstorms business fell off again though Mise expects business to pick up Bristol is considering an ordinance requiring tie-downs for mobile homes Virginia already has a law that will require mobile homes to be tied down after April 15 1975 The Bristol ordinance which has already passed on the first reading will be considered on second reading by the Bristol City Council next month and would go into effect 17 days after it is passed The law would require mobile home parks to provide anchors and tiedowns Owners are given a in a one-hour meeting Wednesday afternoon: Decided to recommend that the city change the name of Elm Street to Cypress Street Gave final approval for the development of Mitchell Estates a subdivison on Orebank Road Approved a plot plan for a sign at the new Kingsport Federal Savings and Loan branch on Fort Henry Drive Agreed to wait for additional information before making a recommendation on the decision to recommend a name change for Elm Street came after Aider-man Dick Stout told the commissioners that the one-block street causes confusion to drivers unfamiliar with the neighborhood Elm
