And how would dyed-in-the-wool Republicans cotton to the idea of voting for a Democrat for vice-president who might become President? As a Texas Democrat Connally has great prestige but how would Democrats like the idea of him teaming up with a Republican administration? It is just possible that instead of assuring the electoral votes of Texas the President might lose them as both Texas Republicans and Texas Democrats turned against him for different reasons There is one thing We doubt if John Connally would be happy if he were in Spiro Agpews shoes at the peresent time or in the shoes of the secretary of state We doubt if he would like to have the name of holding an office next to the President while playing second fiddle to a man who holds no elective office at all? As vice president Mr Connally might be forced even though struggled against it to be a very unimportant man a nonworking cog in the administration machinery while Mr Kissenger was the Presidents alter ego The people who are eager to get rid of Spiro Agnew (and no vice president ever had more vocal cirtics) see in John Connally the next running mate for Richard Nixon The secretary of the treasury has emerged as the strong man of the cabinet replacing Melvin Laird The secretary pf defense who had seemed to be the fair-haired boy With the Pentagon under a cloud for various reasons Laird is catching part of the brickbats But is Connally ready to make this change? And would he as a run- ningmate really help the President very much? There are reasons to suggest that the answer to both questions may be No Mr Connally is a Democrat There is precedent for a President taking into his cabinet men of the other party But there is no precedent for a President to ask a member of the other party to run for vice-president To do so means that in the event of their election and then having the President removed by an act of God there would be a president of the party defeated in the election We doubt if Connally is ready to pull a Strom Thurmond act Connally might function very well as President if given the chance but how jam'es kilpatriek a conservative view- Presidents responsibility Macs Window The silly season for nominations is starting early Anderson and now Gillespie It only remains for someone to nominate Charley Brown In this world of storm and strife Ones span of years is ended It will be so for you and me When its time for us to go We will leave no hole to see A man cant live high on the hog without having a lot of things go to waist And so a country that is economically prosperous must have a lot of waste too power to withhold its consent' and second by the device of life tenure The power is checked also by public opinion and by political pressure When all the checks and balances work perfectly we get to the point we have reached just now Powell and Rehnquist are superlatively qualified for service on the court I have known Powell for 30 years as a great lawyer and a good citizen he is the best Virginia has to offer and by the repeated professional judgment of his colleagues perhaps the best the bar has to offer Rehnquist is possessed of a formidable intellect he is as profound a student of the Constitution as any Sam Ervin or Abe Fortas and he is only 47 He will grow Nixons own judgment is that his two nominees share his judicial philosophy I would imagine that it may be charged that they are conservatives" But surely it is Mr Nixons right deliberately to choose conservatives just as it was Roosevelts right deliberately to name liberals This is the way the system is supposed to work Mr Humphrey would not have named Powell and Rehnquist or Burger or Blackmun either But Mr Humphrey didnt wirj' Wait till next time The President has acted responsibly in every sense of the word One devoutly hopes the Senate will respond In kind The President announced his two nominations for the Supreme Court a little before 8 oclock Thursday evening and the wire services began calling around Capitol Hill looking for reaction The nominees were Lewis Powell of Virginia and William Rehnquist of Arizona How did they strike Emanuel Celler? The old New York liberal dean of the House and chairman Ofits Judiciary Committee allowed himself a small sighrOn the whole good But Powell had been described to him as an archconservative and I would not have appointed him Celler has been misinformed as to Powell the Virginian is a man of law not of ideology but his brief comment invites renewed appreciation of the genius of our constitutional system I would not have appointed him" Of course not But Mr Celler is not President of the United States More to the point neither is Hubert Humphrey and Mr Humphrey would not have appointed him either But Richard Nixon is and Richard Nixon did This is of the essence On the domestic side a Presidents power to nominate members of the Supreme Court is by far his most important power If he chooses wisely wisely that is to say but his own lights and if he can get his nominees confirmed a President can leave his own lengthened shadow on the law We live under a Constitution said Hughes in the famous line but the Constitution is what the judges say it is Precisely And how do we get our judges? We get them by presidential nomination It is curious that so many persons in public life appear to be discovering this truth so belatedly TVo factors may account for the sudden buzz of liberal alarm and conservative delight The first is Mr Nixons candor one might wish in this instance that the President had not been quite so candid The second is recent history Mr Nixons immediate predecessors Truman Eisenhower Kennedy and Johnson had the same power but they seemed never to know what to do with it None of them was a lawyer It makes a difference Truman thought of honoring his pals Heaven alone knows what Eisenhower thought Kennedy and Johnson had two chances each and they used them alike: Each tapped an old friend and each paid a political debt White and Goldberg Fortas and Marshall Nixon is thus the first President since Roosevelt to exercise his appointive power fully knowingly and deliberately in the acknowledged hope of achieving particular ends at law If such a power were absolute our system would fail The judicial branch gradually would fill up with rubber stamps and obedient hacks But the power is not absolute It is checked first by the Senates With most people it can be said that they must be useful as well as attractive Except with airline stewardesses it is the other way around They must be attractive as well as useful If you take a cup of water Out of the ocean vast It leaves no hole in the ocean After you have passed The ocean is just the same as ever Never missing the cup you took You cannot see any change in it No matter how hard you look There is a new trend toward novel wedding ceremonies The idea is to get hitched in some way out way-that will be different Only squares go in for the formal church wedding This is a step in the direction of just making a promise to each other in writing they can show the law and a big blow to the That said the old philosopher Is the way with a human life After it has run its course The world goes on with its storm and strife The older generation will not like this very much Except perhaps fathers of brides-to-be 4 i a ixilmrr jr Evers has outside chance Teens own idea To the Editor Many thanks to the Times-News Teen Scene Editor Lyndia Frazier and photographer Earl Carter for the excellent account of the Ruriteen project of repairing an elderly gentlemans home (Friday October 22 Times) This project as all other projects of the teen club since their organization in March of this year was carried out entirely on the initiative of the teen members After learning of the old mans plight THEY decided what to do and did it! What America must not forget is that there are little Mississippis wherever there are dark ghettos both in the South and in the North The seat of Jefferson County the fourth poorest county in America Fayette offered ittf citizens a poor existence In 1960 the median Income of the countys whites was $4180 per year and of blacks $890 i Close to two-thirds of the black families were on welfare There was one resident doctor in the county and the health of the citizens reflected that deficiency There was also only one police car in Fayette and it was in such poor condition that no one was ever sure it would start Garbage collection was sporadic primitive and highly selective with blacks in particular suffering from lack of service" The quoted words come from Gilbert Jonas a national coordinator for the Evers gubernatorial campaign He described two years in Fayette" in an article in Freedom at Issue Jonas recalled that until a few months prior to Mayor Evers election not a single foot of paved street existed in the black neighborhoods of Fayette One street was paved before the inauguration however which resulted in leaving the new Evers administration without sufficient funds to finish the last quarter of the 1969 fiscal year Evers made a nationwide TV appeal for funds for his town and $80000 poured in Actually America has come to the aid of Fayette since Evers took over and things are a little different now So much needed to be done to help Fayette In Though the possibility is remote a black governor of Mississippi could be elected Tuesday Charles Evers the black mayor of Fayette Miss is making history with a serious bid for the chief executives chair in the state long considered to be the citadel of racism In a last-minute legal action Evers is seeking to have his major opponent Atty William Waller disqualified Evers is charging that Waller violated the law by spending more thqn $50000 in the' primary campaign The word leadked out that the suit was in the making a Mississippi Supreme Court Justice Tom Brady entered the race to make sure a white man would be on the ballot Nov 2 It was Bradys intention to withdraw from the race once the litigation against Waller was disposed of However the deadline for withdrawal passed before Brady could bow out Inasmuch as Waller is not likely to be legally disqualified voters in Mississippi will no doubt find on the ballot the names of two white men and one black man By some miracle whites could split their votes between Waller and Brady in such a way that Evers could squeak through to become the first black governor of Mississippi Regardless of what happens at the polls Tuesday it is revealing to know what has happened in Fayette since May 13 1969 when an all-black government was elected in that Mississippi town populated by both blacks and whites niilir roYlitf uiisilvnl -minonl Frank Cerone finally made it few years ago Frank bought a big car but the IRS grabbed it and auctioned it off That was the last time he owned a car He apparently pays for everything with cash so there is no checking account If he has a bundle stashed away somewhere its not in any savings account And there is no paycheck to intercept because the crime syndicate doesnt pay its wire-room overseers that way He manages to avoid obvious high living because if the government could prove that he was spending more than enough to pay his taxes they would have him But so far they haven't been able to do it And in all likelihood they never will The tax liens for Frank go back to at least 1941 probably earlier He's an expert at it after all of these years Think about him the next time you riakc your tax payment I Hes been doing it for years It may be that he has never in his entire life payed any income tax: Exactly how much hes beaten the government out of Isnt known Officially the figure is something like $75000 But it must be many many times that amount since Chicago has a lot of horse players and Frank gets a piece of everything bet with any bookie In a major part of the city And he keeps every penny of his earnings because he is one of the few people who have been able to beat the income tax laws He does it by filing an Income tax return each year right on time but not paying The local tax people hate to talk about Frank he makes them so mad How does he do it? First of all there Is no record anywhere that Frank or his wife Mary own anything A misfortune to stand trial before a judge who had lost two sons in World War II and he did six years in prison Then in the 50s a business dispute over slot machine territorial rights caused somebody to let go at him with a shotgun as he strolled a suburban street Thats been it for Frank Even his late brother Dan a teamster union official made a bigger splash That was when a dispute over union management prompted someone to run Dan over with a car While Jack became known to millions who follow the adventures of Chicagos gangsters cousin Frank just plugged along handling Jacks bookie Joints But Frank it turns out has a remarkable distinction to his credit Hes done something that few people gangsters or otherwise have been able to do He doesnt pay any income tax Not a nickel And he gets away with it CHICAGO Frank Cerone has never been nearly as famous a gangster as his cousin Jack Although they both came out of the same tough neighborhood where they apprenticed as stickup men and extortionists it was Jack who went on to glory It was Jack who became a suspect in at least four neatly done syndicate hits" who became the wheel mqn for Tony Accardo who got a big house in a suburb Joined a private country club took the 5th on TV before a Senate committee and finally rose briefly to the top of the Chicago syndicate Even though he is currently in prison Jack is still considered one of our outstanding evildoers But cousin Frank who' is a year older has made headlines only twice Once was in the 40s when he was caught selling draft deferments He had the.
