Bill would require 2 to consent to taping A Richland County lawmaker wants to keep people from taping conversations with friends and enemies without their knowledge. The bill, introduced by Sen. Darrell Jackson, D-Richland, would make it illegal to record people and play the conversation to others or pass on an e-mail without the other person's knowledge.

A Senate Judiciary subcommittee on Thursday took up the bill, which drew opposition from people in the media, private investigators and government agencies. South Carolina law allows either of two parties involved in a phone conversation to tape a phone call without telling the other. "We think it's overly broad and it could hinder the press in the gathering of legitimate news as it's written," said Bill Rogers, executive director of the South Carolina Press Association. Most reporters tell people when they are being recorded, but "a reporter who forgets, shouldn't be a criminal." Jackson said he would restructure the bill. "We're going to narrow it to individuals who tape other individuals to use that tape for malicious use," Jackson said.

Jackson proposed the bill after a constituent told him she had had a "very personal, private, graphic conversation" with a friend. The friend "took the tape to their job and let people listen to it as a joke." Good taste can't be regulated, Jackson said. "But you can regulate some deviant behaviors," he said.
