In January, a Premier League disciplinary panel concluded that Boro did not have just cause" for unilaterally calling off the match. The club were docked three points and fined £50,000.

Premier League officials are concerned that should Boro escape with just a fine it would establish a precedent the price for other clubs to postpone Premiership matches. The League believe the only deterrent is to dock points. The FA commission have the power to alter the original punishment, even adding to it. However, the Premier League feel it would be wrong to award Blackburn the three points, which Rovers want, without actually having earned them. Middlesbrough's trump card could be George Carman QC, who has some notable successes to his credit, such as defending Imran Khan against a libel action by Ian Botham and Allan Lamb last year.

Carman is sure to present a formidable -head challenge for the Premier League's own distinguished representative, Anthony Grabbiner QC.
