syn dicate of ill persons and one cor poration for a gambling license for the lamingto Hotel on the Las Vegas strip recently pur chased bv the group for $8300 000 Gamblers Eddie Levinson and Mike Shapiro formerly licensed at the Sands Hotel in Las Vegas were approved as license holders of the outgoing corporation which still operates the lamingo Al Parvin Los Angeles hotel equipment dealer who is the ma jor figure in the new syndicate explained Levinson and Shapiro would take over direction of the casino until Jan 1 when the group hopes to take over the lamingo provided the new stock holders win tax commission ap proval ive Other Members ive other members of the new syndicate are present lamingo licensees They include Eddie Barrich Gaughan Chester Simms Sam Ziegman The commission made it that licensing of Levinson and Shapiro in the hotel for the time did not guarantee that stockholders would be Allan Lindsey of Sparks filed petition in district court yes terday asking permission to set tle a disputed accident claim in half of his 11 year old son Allan The younger Lindsey was in jured November 26 1953 when the automobile ii which he was a passenger was struck by a (U) Democrat Alan Bible finally won a certificate of election to succeed the late Sen Pat McCai ran as United States senator to day following a five hour delay caused by a squabble over a re cent opinion by Attorney General William Mathews The signing of the certificate by Gov Charles Russell at 3 pm paved the way for Bible to be sworn in as junior senator from Nevada sometime Thursday fol lownig completion of a Senate vote on censure of Sen Joseph McCarthy Bible who is in Washington had hoped to be sworn in today but delays caused by numerous votes and debates on proposed amendments to the censure mo tions made this impossible Smith lies East Three Deferred Many Others Have irst Reading Variety of Crimes Listed It appears that the last month of the year will boost the 1954 divorce total past the 4400 mark compared with 4 03 the full year 1952 4734 in 1950 The divorce in seven consecutive years prior to 1950 and reached an all time high of 11060 in 1946 There were 401 divorce suits filed here last month' compared to 423 in the same month a year ago Marriage licenses issued last month totaled 1603 almost iden tical to the total for the same month a year ago 1605 but a decline in several previous i months of this year leaves 1954 There were 70 traffic accidents and nine traffic injuries in Reno during November the police de partment announced yesterday in a monthly report The summary of the traffic record compiled by Capt Louis Spitz showed that the num ber of accidents to date this year is much lower that at the same time last year There were 982 accidents and 118 injuries during the first 11 months of 1953 and this year there have been 781 ac cidents and 63 injuries during the same period The monthly summary broke the traffic accident figures down into age groups violations time and location Speeding Main Cause More than one third of the acci dents resulted in citations to drivers for speeding or for failing to yield the right of way the re port showed A total of 13 drivers were cited on right of way charges and 11 were blamed for excessive speed which contribut ed to the accident Seven drivers in accidents were charged with being under the in fluence of alcohol A large number of the accidents involved drivers between the ages of 16 and 24 the report showed There were 37 motorists in this age group and 34 in the 25 34 age group More than a fourth of the acci dents occurred during the rush afternoon hours from 4 to 6 pm the report showed Twenty of the 70 accidents were reported dur ing this period There were 36 daylight accidents and 34 night accidents Of the 126 drivers who were in volved in accidents 105 of them were men A total of 34 drivers were from outside the city Mail Th ft Charge Is acing Prisoner A Community Job Help Build to the monthly report of arrests made yesterday by the police department That does not include the 172 citations issued for traffic violations Drunkenness again led the list cf causes for arrest with 197 persons charged on this count Vagrancy wras the second most frequent misdemeanor with 142 booked There were 46 persons charged with miscellaneous non traffic offenses Nine persons were charged with burglary during the 30 day period and 13 were booked on suspicion of larceny Embezzle ment and fraud accounted for seven arrests and drunk driving citations went to 17 More than 85 per cent of those arrested were men Only 74 wo men were booked during the month Driving and road violations re sulted in 121 of the traffic cita tions and 51 were non moving citations DeLuxe Taxi Service wafc Desert Spa on the Las Ve gas strip were ordered by the state tax commission today to withdraw Gambler Sol Gershen horn as one of their prospective partners The commissioners voted unani mously to inform the applicants that Gershenhorn a former Los Angeles gambler was undesirable because of his background and past associations At the same time the Desert Spa application was deferred pending further investigation of its proposed operators In particu lar the commission indicated it wanted to know more about the finances of red Weichmann and A Toberoff of Los Angeles and Charles Marems of Stockton Calif The commission said it could not act upon the applications of the remaining partners because Gershenhorn was included in the original list of applicants and be cause Weichmann Toberoff and Marems faced further scrutiny Las Vegas Attorney Dale Cook representing the Desert Spa was called before the commission and informed that the agency did not want Gershenhorn connected with the project in any way if and when the motel a i was I granted a state gaming permit Cook said he understood the re quest and that his clients had al ready agreed that this would be done Earlier red Trevillian a for mer Santa Barbara Calif hotel operator who is putting up the major portion of the money for the Desert Spa told the commis sion he was in a financial position to buy up the interests of any ap plicants found objectionable by the agency The Desert Spa partners had hoped to open the motel casino by Dec 15 but this will be impos sible now since the commission will not meet again previously by Koontz Mr Smith then went to Gov Russell to ask that he sign certificate of election speedily so the Reno attorney could take his Senate seat as soon as the Mc Carthy censure voting was com pleted and thus gain as much sen iority as possible However Russell declined to do so immediately He pointed out that Mathews in his ruling fol lowing death in which h'e held an election must be held to determine who would succeed McCarran for the balance of his unexpired term ending Jan 3 1957 said among other things that the term of Sen Ernest Brown ended Jan 3 1955 This resulted in considerable argument Russell at the time was presiding over the tax com mission and also attending a high way board meeting Telephone Conversation inally shortly after noon Gov Russell talked by telephone with both Bible and Brown in Washington Russell then agreed to ask Mathews about his earlier ruling saying "in line with that opinion in good' faith I named Ernest Brown as United States senator under the assumption that his term would not expire until Jan 3 Ru sell asked Mathews whether in view of the supreme court de cision that an election must be held to name succes sor and subsequent elec tion on Nov 2 the former opinion still held Mr Brown's commission extend to Jan 3 1955 or is Mr Bible by law qualified to take office as of this Russell asked Mathews At 3 pm Mathews sent a letter across the street with a new rul ing Mathews said Bible was in Washington and that he (Math ews) had been informed Brown was willing to surrender his office to the Reno Democrat Mathews said when he rendered his former opinion he did not know whether an election would be ordered by the supreme court The attorney general said it now appeared that Bible had been declared elected by the supreme court to fill the Senate vacancy caused by death that he is now in a position to qualify for such Bible Mathews held now qualified to assume his duties in the United States Senate as of this Russell then signed the certifi cate of election and the way was thus paved for Bible to take his Senate seat A check disclosed that the for mal commission of office given Brown by Russell said he was against what the opposition termed tel commercial structures in residential neighborhoods Second strongest argument against the two requested vari ances was congestion of traffic in both areas Both proposed apartments are close to schools it was emphasized where traffic safety is already a problem Pos sible daily rentals of apartments or rooms was mentioned as at tracting an undesirable group of persons to the neighborhoods In the case of the Reno Ave struc ture it was noted that only 20 off street parking places were planned and only six for the La Rue Plumas project Property Values Cited gambling industry while supporters accused the governor of using the tax com mission as a political weapon in the Thunderbird matter ollowing Russell's reelection the executive committee of the Washoe County Democratic Cen tral Committee announced it would ask the legislature to in vestigate the tax commission's role in the Nov 2 election Russell proposed the show cause order to his six fellow commis sioners late this afternoon He asked if any member had any objections and when none was forthcoming he ordered the owners informed of the show cause hearing Russell said the revocation ac tion
