Nightingale told of ficers the man accosted her be tween 9:45 and 10 pm as she was walking to the rear of 610 Cen ter St She said he began choking her but ran when she screamed for help Police said no attempt was made to steal Mrs purse Thirty four youngsters got into trouble here last month the Reno police juvenile bureau reported yes terday Twenty seven of the children were boys and seven were girls Thirty of them were first offenders three were second offenders and one was in trouble with the law for the third time Contrary to popular opinion very few of the youngsters who got into trouble came from broken homes Twenty three were living with both parents and the rest were living with either one or the other of their parents Nineteen of the juveniles coming to police attention were non resi dents and of these 16 were appre hended as runaways ifteen of the youngsters were 17 years old one was as young as 12 and none were older than 17 Outside of the 16 runaways eight were cited for traffic offenses one was held for petty theft three were held for curfew violation and two were held for other misdemeanors Only four of the young violators were charged with a major offense All four were accused of auto theft Seven youngsters were remanded to police traffic school In six cases action was suspended and 21 cases were referred to other depart ments Peterson of 1058 Watt St told police yesterday he is con cerned about the activities of youngsters in his neighborhood Mr Peterson said someone ap parently juveniles has been drink ing beer and then breaking the empty bottles on charged with performing an abortion on a 21 year old Santa Monica Calif girl in Las Vegas last March 11 Winter of Las Vegas was arrest ed on a complaint signed by District Attorney George Dicker son The physician denied the charge The girl who authorities refused to identify is recovering from the operation in Southern Nevada Memorial Hospital She entered the hospital on March 25 and was re filed in district court yester day by counsel for Edward Wal ters Walters was found guilty of pan dering in municipal court His taxi badge was confiscated by the police department Walters filed notice of appeal from the pan dering conviction and then insti tuted mandamus proceedings to re cover the badge His petition said the municipal court conviction was not related to his ability to drive a taxi cab It is alleged that confiscation of the badge violated consti tutional rights 1 District Judge Harold Taber scheduled a hearing on the man damus petition for 2 April 6 Walters is represented by and attempt ed suicide the jurors voted on the degree of guilt and the fourth bal lot was for the death penalty Sentence will be imposed by Dis trict Judge John Belford on April 13 After the verdict was announced and the jury was polled Judge Bel thanked the jury He then ilurned his attention to the attor neys complimenting Prosecutors Emile Gezelin and William Raggio and the defense attorneys Goldwater and Drendel Goldwater Commended help particularly com mending Mr Goldwater and Mr udge Belford said are very busy lawyers but they have given unstintingly of their time to present a very able defense in this case under a ourt appoint ment so long as a penniless de fendant can obtain the type of de fense presented here I feel that these United States have nothing much to The jury received the case at 4 and returned the verdict four and a half hours later but an hour and a half of that time was spent at dinner in a downtown restaurant There was considerable public Interest in the two week trial About 20 persons were present when the verdict was returned Judge Belford deemed it advis able to warn the audience in ad vance of the verdict that will have no Argument In their address to the jury yes terday Prosecutors Gezelin and Raggio charged that every ele ment of first decree murder was present In the fatal shooting of Betty Sue ox 21 mother of two small children They attacked insanity de fense declaring that he was methodical and rational when he set out pistol and bullets for his estranged home last October 7 They pointed to three suicide notes he had written all of which indicated his intention to kill his wife and then himself Raggio termed the shooting of Mrs ox atrocious and Gezelin said it was Both men asked for the death penalty The defense sought to prove that attempted suicide which cost him an eye was a of his a form of insanity Gezelin countered that conten tion by telling the jury that the defendant's paramount urge was not suicide but murder Goldwater in his closing address to the jury recalled the testimony of two defense psychiatrists that ox was insane at the time of the shootings and he attacked the testimony of a prosecution psychi atrist who said the defendant sane would hesitate when hds spared him to do what God did not Goldwater said re ferring to the unsuc cessful suicide attempt and the 'prosecution's demand for the death to maintain his permanent residence here Wives May Vote One of the oddities of the soldier voting restriction is that service wives may register and vote whereas their husbands may not Mrs Sampson for example is a registered voter Colonel Sampson is represented in the district court proceedings by Attorney Grant Bowen After the petition was filed Bowen obtained an alternative writ of mandate from Drew a state gambling license for a 25 per cent interest in Golden Hotel Bank Club casinos The vote was cast by Commissioner Robert Allen of Carson City Public Service Commission chairman The action came after Drew denied under oath he had been engaged in gambling at Hot Springs Ark as the com mission has been iniormeu oyt sources staff investigators re 1 garded as reliable He was told that the commis sion had been informed by what was described as a reliable source that he and Leslie Kruze another former Chicago gambler had op erated gambling games at the Reno Club and the Pine Hotel last ebruary A short time before this Drew had told the commission he had no gambling operations whatso ever outside the state nor planned to engage in any Under oath Drew denied the allegation and said that although he was in Hot Springs at the time and saw Kruze there his only gambling activity consisted of playing poker craps bingo and horse races as a customer He said he understood that he could be tried for if his statements under oath were found not to be true He asked that because his ap plication had been pending for several months that the commis sion either grant or deny his license so district court to test soldier vot ing law The Stead officer is seeking a writ of mandate to require County Clerk Harry Brown to give him and other military personnel similarly situated the right to register and vote The county clerk said he welcomed the court test of the law which bars servicemen from voting unless they were residents of Nevada prior to their induction The soldier voting regulation is based upon a clause in the state constitution which says military personnel may gain nor residence for voting purposes by virtue of their military service Abiding by opinions of the Washoe county district attorney's office and the attorney general of the state the county clerk recently found it necessary to refuse Colonel Sampson the right to register for the primary election Refusal Sets Stage That refusal set the stage for the mandamus proceedings instituted yesterday by the Stead officer The state law requires as a con dition of voting that a person be a resident of Nevada for six months of the county for 30 days and of the precinct for 10 days immedi ately prior to election except that out of state servicemen may not vote Interpreting the law in the light of the constitutional clause attor ney generals in the past have stressed the point that a military man is subject to transfer against his wishes hence has no capacity to establish legal residence Colonel petition cited a number of circumstances tending to substantiate his claim that he is indeed a permanent Nevada resi dent hence entitled to register and vote The petition said he moved to Nevada from California in 1951 having been voluntarily assigned to Stead AB He purchased a home at 1610 Allen St Reno where he resides with his wife and three children He pays Nevada taxes on his home and Pedrini and evidence of one or more attempts by Pedrini to escape from the Washoe county jail since his arrest Shortly after his arrest in Cali fornia Pedrini reportedly made a statement admitting that he shot Dodd and declaring that both he and Linden strangled the victim with a rope Subsequently however both men pleaded not guilty to the murder charge In the motion filed yesterday Attorneys Bruce Thomp son and Leslie Gray said that at a joint trial of the defendants will be impossible for the attorneys ap pointed by the court to argue the relative guilt or innocence of the defendants inasmuch as any argu ment made by them regarding the innocence or lesser complicity of one defendant will necessarily indi cate the guilt or greater complicity of the other" provided felonious
