Elliot Smith 40 a Weed Calif laborer was arrested in a downtown parking lot after the attendant caught him climbing into a parked car to go to sleep Smith served previous terms in Washington and Oregon prisons for grand larceny and robbery Police believe the man to be an escapee from a California prison and a check of the penal institutions is being made It was determined through information from Warden Richard Sheehy of the Nevada state prison that story was untrue He will be allowed to leave town if the identification bureau of the department finds no evidence for complaint A 2 1 $110000 SCHOOL AT READY TO GO NEW GOVERNOR MAKES THREE APPOINTMENTS shock was a verticle one confined to the Reno and Sparks area It was not felt at Herlong which suffered principal damage from the shocks a few weeks ago and no report was made of it in Verdi 1 Catching Reno right in the middle of a busy afternoon the power failure sent attendants in the grocery markets hurrying to the cash registers with hand cranks In the barbershops hand operated clippers were called into use and candles were lighted in many business houses The shut off was brief however and once the station at Mogul Goes Into Effect BLOWS UP DUE Earthquake which shook Reno and Sparks at 3:32 yesterday after noon set off a short circuit at Mogul which practically blew up a switch station and shut off the elec tric power for this whole section of Washoe county A strong wind was blowing at the time and the earth tremor was just enough extra to make two high tension wires come together at the Washoe switch yards of the Sierra Pacific Power Co at Mogul The result hair raising Sparks flew out of the wires and up the poles in such a way that the light could be seen for a long dis tance The affair was accompanied by a resounding that could be heard for half a mile When the workmen ran outside to have a look there was plenty to see The sparks were still enveloping the towers and a good share of the whole switch station In the meantime the electric service had gone off It remained off until workmen were able to wire around the burned out switch yard and send the current on into Rene and Sparks leaving the yard at Mogul isolated 'X Plaster Cracked Here in Reno and Sparks the shock was spectacular enough It rattled buildings cracked plaster and caused a great many questions although not much actual treasurer John Koontz secre tary of state Mathews at torney general Cliff Jones lieu tenant governor and Chag Russell governor Chief Justice Badt explained that the law required that the lieutenant governor and the governor of the state be sworn in singly and he asked the others at the table to rise raise their right hand and to re jpeat after him in unison their oath of office Then Lieutenant Governor Cliff Jones was sworn in by the chief justice And 30 seconds later at 2:15 Chief Justice Badt adminis tered the oath of office to Governor Russell I Compliments Merrill After he had administered the oath of office to Justice Merrill Chief Justice Badt complimented the Reno attorney on being a mem ber of the supreme court of the state stating that Mr Merrill had long been held in high esteem by the bar of Nevada TAfter administering the oath of tiffice to Gov Russell the chief jus tice said he was entering the office of chief executive at a difficult time and that the people of Nevada looked to him to guide them safely through this moment of uncertain ty He invited Governor Russell to make a statement but the newly elected chief executive stated that he thought that it might be better to wait until after the ceremony be forre issuing any statements When the supreme court had been completed by the swearing in of Justice Charles Merrill Chief Justice Badt called upon Rev Charles Swineford pastor of the Methodist church in Carson City for the invocation The minister asked for divine guidance for the elected officials about to take the bath of office called upon the mem bers of the legislature to put aside party politics in the forthcoming session and upon the citizens of the state to remember that they owe a duty to the state jXThe administering of the oath of possible rank A Tortorello 39 year old handyman yester day waived his right to a preliminary hearing on the charge that he murdered Maude rary Russell here October 29 Tortorello was wearing a heavy bandage on his forehead when he appeared before Justice of the Peace Powning in the State Building He reportedly injured himself by butting his head against a cell wall in the jail at San Diego where was arrested recently Highly Nervous The defendant who is charged with having strangled Mrs Russell 58 year old Salvation Army work er in her cabin at 330 Chestnut St was highly nervous during the jus 'tice court hearing After Judge Powning read the first degree murder cpmplaint and advised Tortorello of his rights to a preliminary hearing the prisoner said he wished to waive the hearing and he signed a statement to that effect As a result the case will be cer tified to Washoe county district court for action in the near future Tortorello is a slightly built man Yesterday he was wearing a gray pin striped suit and a blue work shirt open at the collar His face was unshaven and his hair was rumpled Authorities who would not be quoted said that Tortorello has spoken freely of the murder case A press service dispatch from San Diego after his arrest quoted him as admitting the slaying On October 29 the day of the murder other residents in the tour ist court where Tortello and Mrs Russell were staying heard a vio lent argument in their cabin The murder was not discovered until two days later Tortorello had dis appeared He was discovered about two weeks ago working in a San Diego cafe In Reno and Sparks he had been a carpenter and painter Tortorello is said to have told authorities that his argument with Mrs Russell occurred when she de manded that he go to work at a job "That is the only way to make possible the importation of machines to the state Wide Territory The new law covers wide terri tory One section outlaws use of slot machines on any land under exclusive federal jurisdiction This will compel the armed services to toss them out of clubs The measure was the first to be written into the statute books as the result of concern over the spread of organized crime and gambling It has been estimated that gamblers have grossed $2 0000001)00 annually from slot ma chine operations Congressional experts have esti mated there are some 150000 slot machines in operation The measure makes it a federal crime for'anyonc to ship a slot ma chine or any parts of a slot machine across a state line into a un less a state now takes specific ac tion to exempt itself from the fed eral law 5 Nevada is the only state which has legalized statewide gambling But under the new law its legisla ture now must take affirmative action if it wants to continue to receive £lot machine shipments Tough on Jennings Harold Jeske vice president of the Jennings: Co which usual ly does a $2500000 annual business in slot machines said the company hopes to get government contracts to help keep the factory going dur ing a conversion period but added that contracts have come through so far If they get work soon more men will be laid off he said Jeske said the company will have to convert completely in order to make typewriters adding machines and machine parts because the vending machines it makes other than slots are made with slot ma chine parts which also are banned from shipment'under the new law The 50 year old firm is reduced immediately to operating at no more than 10 per cent of its ca pacity output Jeske said rom other sources it was re ported that some of the larger manufacturers are considering a possible court test of the law None would comment on this possibility however Charles Russell became the governor of Nevada at 2 :15 yesterday afternoon The oath Earl Wooster of Reno and Proctor Hug of Sparks said yesterday Despite the fact that every stu dent was informed of the reopening date there has been confusion after the long holiday and it is likely that some children will be reporting for classes today Although the elementary and high schxls will resume classwork at 9 am Thursday the University of Nevara will reopen today Wom en's dormitories on the campus were opened last night for the con venience of those returning early The 74 pupils of Huffakers school will enjoy another five days of va cation returning Monday The rea son for the long holiday there is that the Huffakers staff is still busy moving school equipment from the old school building to the new one which will hold classes for the first time January 8 Tale Declared Untrue District Judge Priest has refused to enjoin Eugene Jarvis prominent restaurateur from op erating Chalet a restau rant and guest house in an exclu sive district at Crystal Bay Thirteen property owners in Crystal Bay Park subdivision sued Jarvis who formerly owned Eu restaurant on Virginia Road asking the court to order him to close on the grounds it violated subdivision covenants During the trial held several months ago the plaintiffs contended that the deed transferring lot 37 to Jarvis specifically provided that he could not use the property for com mercial purposes 7 Jarvis admitted that the cove nants were listed in the deed but he said this was a mistake which the Crystal Bay Corporation had promised to amend He pointed out that the same lot had previously been used as the site of Club Crys tal a night spot that burned down Judge Priest delivered his de cision yesterday saying: reason of a want of convinc ing proof that lot No 37 was embraced within a plan of the Crys tal Bay Corporation that it be sold with restrictive covenants and by reason of the time element of the acquisition of various parcels there in the decision is for the de The element of acquisi apparently referred to the fact that some of the plaintiffs' in the case against Jarvis had bought their property Crystal Bay at a time when Club Crystal was oper ating The plaintiffs were rantz Walter Tobin Acrea Clyde Mast and Norbert Van Buren and their wives and Hildegard Willman Harry Marsh and A Storz They alleged that operation of a commercial establishment in what is otherwise a residential area de preciated the value of their prop erties Mr Jarvis who opened and op erated restaurant on Virginia Road for some time be fore going to Lake Tahoe bought the lot at Crystal Bay in 1916 ollowing the opening of his Cha let there the objections were heard by the planning commission of Washoe County where the whole case was aired When no final solu tion was reached through those channels the case
