Tonopah Mine Operator Dies After Illness TONOPAH, June 19 Hearing of Power Rates Postponed The hearing of the electric, water and gas rate charges of the Sierra Pacific Power company, scheduled in city for Thursday of this week, has been postponed un- itil Friday, July 7, according to an' nouncement yesterday by the Nevada public service commission.

Bank Assessment Claim Is Argued In Federal Court CARSON CITY, June 19-- Frank Wilson was today sentenced to'four months in the Ormaby county jail and fined S150 and costs, but granted immediate probation, when I he plead guilty in the federal court to a charge of having conducted a common nuisance on April 30 at Las Vegas in a building as The Shack and located between First and Second streets. CARSON CITY, June demurrer of Carl Otto Herz of 'Reno to the complaint recently -filed, against him by W.

J. Tobin as receiver of the Reno National Bank to secure judgment for $2,500, interest and costs, was argued today in the federal court. After briefs in. the matter have been submitted the case will stand submitted to the court. Tobin brought the action against Herz to collect the assessment levied, by order of the comptroller of the currency, against the stockholders in the bank, the assessment being $100 a share.

In his demurrer to the action. Herz claimed that Tobin does not have the capacity to sue and thit there was a misjoinder of the parties defendant for 'the reason that the bank was not made a party defendant. Mountain Passes Open to Through Travel In Sierra Both Kit Carson Pass and the Ebbetts Pass secondary routes across the Sierra were opened to traffic on Saturday and are declared to be in good to fail- condition, according to word received here yesterday 'by the Nevada state automobile association. Reopening of the Tioga pass to the Yosemite was announced last week, leaving only the Sonora Pass into Mono county, unavailable at this time. A bulletin from California touring officials states that motorists driving from Quincy to Beckwith.

Plumas county, are cautioned that the entire distance of 37 miles is covered with from two to three inches of crushed rock, not gravel, and is extremely hard on tires. The road is under construction by the federal bureau of public roads. and until it has been smccthed down and surfaced, poor conditions will be encountered. Motorists also in the" vicinity of Lake Atmanor are cautioned against driving from Westwocri to Greenville, via the eastern side ol the lake. The road is declared to be extremely rough and corrugated, and ibstter 'traveling is possible en -west side of.the lake.

Lookout Stationed At McCellan Peak Rex Levissee. formerly stationed at Galena Creek, has been assigned as lockout at McCellan peak in the Virginia range south of Rene, where a man will -be on duty throughout the forest fire hazard season, it was stated here yesterday. The: station at this peak, commands a view of tha entire ed area west of this valley and Washoe valley to the southwest I near Carson City. A road was built the summit of the peak i last year by Washce county, and telephone- line installed. The station is in charge of the feres: service.

With a large gathering of old I time friends of western in attendance, the funeral of the late Carsten M. Hennlngsen was held yesterday afternoon at the Lutheran church at Gardnerville.
