At least one juror clearly misunderstood Petersen's instruction to the jury regarding circumstantial evidence, Vroman said. Another reportedly told attorneys: "It's a good thing (Massini) didn't ask for the death penalty or we'd never have been able to vote to convict (Lester)." Massini has indicated she may seek to try Lester a third time for the decade-old slaying of the Billy Grondalski family. Massini is at a San Diego conference today. Deputy District Attorney David Basner will be in court at 1 p.m. this afternoon to convey Massini's wishes to Petersen. "A third trial is a possibility," Vroman said. The lone holdout on the jury was a woman, the daughter of a retired Los Angeles Superior Court Judge. The woman, Vroman said, had found the testimony of the state's key witnesses, Charles Haas and Michael Tankersley, riddled with inconsistencies. While admitting that Lester might be guilty, she felt the state had failed to prove its case. Grondalski, his wife, and the couple's two children were shot to death in October 1986 at the family's rented farmhouse on the Fort Bragg outskirts. Massini had asked the jury to find Lester guilty of second- degree murder in Grondalski's killing and asked for a verdict of first-degree murder in the killings of Grondalski's wife, Patricia, teen-ager Nolan Vande- graff and 5-year-old Dallas Grondalski. If convicted, Lester would have been spared the death penalty, but could have been sentenced to life imprisonment. Massini did not introduce any new evidence in the case, Vroman said. Plowshares says it contacted the Senior Center to see if the board of directors would allow it to use the center's dining room to serve lunches because it is an excellent facility, and provides an atmosphere of fellowship and social activities for seniors. But Tuesday the Senior Center board met and decided to not open up its dining room to Plowshares. However, the meals situation was to be discussed this morning at another special board meeting. "I still think it's up in the air," said board member Helen Smith. But with the funding from AAA gone, Smith said she and one other member of the 12-person board are in favor of turning over meal preparation and service to Plowshares. "It would get rid of the expense of hiring cooks," Smith said, "and the expense of buying food." Meanwhile, the Senior Center is planning to continue to serve lunches at the Senior Center after July 1, charging $3 for lunch and $5 per meal for a home-delivered meal program called Meals To Go. Smith doesn't know how many seniors will be willing to pay for lunches if they can eat for free or give a donation to Plowshares for the lunches it supplies. "It will be hard to make it without AAA funding," she said of the Senior Center's lunch program. "The first two weeks in July will tell the tale," she said. If the center loses its patrons, Smith hopes it will contact Plowshares and work something out. Plowshares plans to cook all the meals at its Luce Avenue kitchen and transport about 40 lunches a day to the Episcopal Church on Orchard Avenue, said Brodsky. The Mendocino Transit Authority has offered to put benches out by the church and create a stop there along an already established bus route, she said. While Plowshares now server about 100 meals a day, that rrarrt- ber will increase to 200 or more when it begins providing meals to seniors.
