conducting controlled forest bums under provisions of a state permit the state Supreme Court ruled today The unanimous decision upheld a lower court ruling dismissing a $250 fine levied against the Simpson Timber Co by the Olympic Air Pollution Control Authority The fine was levied in 1972 after the Simpron Timber Co conducted a slash bum on 78 acres of its property about nine miles west of Olympia The bum produced noticeable smoke and particulate fallout in the Olympia area a situation the Olympic Authority stated violated Its Regulation One That regulation states that per son shall cause or allow the emission of particles of such size and nature as to be visible individually In sufficient number to cause annoyance to any other It levied the $250 fine under provisions of that regulation Simpson appealed the case to the WHCAT (UN to UTt J4TT I IN Jut 1SSM 157 ISA Mi See 111 144 111 JNM Dec AW 17V) MU or Mm las mi CONN (MN to) Mey 47 MB INVi Ml Jut 1714 171) 171' MB i I70M
