OATS HAY THERE IS NO INTENTION OF I'LAY A CARD Iteault of Overcrowding In the County lrlou. John C. Chase, sanitary engineer and member of the State Board of Health, is in the city for a few days, stopping with bis friend Lt. A. H.

Cobb on Mont ford avenue. Tbe State Board of Health has undertaken a sanitary inspection of tbe various State institutions as well as tbe water supply and methods of age disposal in the principal cities and towns, and Mr. Chase is here to farther this ol jfct. This morning Mayor Patton escorted Mr. Chase and Tub Citizbn on a tour of inspection that included tbe City Hall Central market, fire department, court bouse and tbe county iail.

The sanitary features of Ibecitv departments were found to be in good condition, bat tbe visit to tbe jail revealed a bad state ol atlairs as a result or overcrowding, Ninety-fire persons were berded to gether in the prison last night, in cages and cells that bare scant accommoda tion for 40. White and black, old and voung. ail ing and well, the man who sold a pint of blockade liquor, tbe common. thief and tbe murderers wno are sentenced to the death penalty early in January all were penned together like cattle and only able to hare relief from the sickening surroundings wben tbe court officers appear with an order that removes a batch of the onlortunat.es for trial in tbe Federal court. The worst aspect of tbe case was ob served in the lower cage where the floor was sloppy in places from which a rank, fetid odor arose and pervaded tbe atmosphere of tbe cages and corridor.

Tbe air was stifling with the dust of lime from the constantly shuttling feet of the trans gressors and the bad prison smell. A more disgusting exhibition can scarcely be conceived. Said one of the prisoners: "This is an awful place. We couldn't sleeplastnigbt; bad to lar and stand on each other, and tramp about. We hadn't enough blank ets and couldn't kep warm." Mr.

lamison, tbe jailer, told tbe vu- itors on entering that he was ashamed of tbe place, but that he was doing the best be could in tbe face of the over crowd, which is caused bvthe large nam ber of prisoners from tbe federal court, The Citizen knows from personal in spection at former times that tbe jail is under ordinary conditions kept cleanly. "They're filthy, indeed ther are," said the jailer, but tbe commonwealth's iuspector ot health was unprepared for the half of what he saw. IX FOREST FIRE DISTRICT'S. The Newlv Elected Feared the Old Legislature Could Be Called In Extra Session and Chooao Vauice'a and Run' aom'a Successors. Washington, Nor. 15. In regard to tbe statement that an effort might be made to convene the late legislature of North Carolina in extra session for tbe purpose of electing Democratic Senators, before the new legislature could do that work, Senator Ransom said to a repor ter this afternoon 'There is not a word of truth in it, and tbe statement has not tbe shadow ol foundation. Mot a word like it was ottered at the meeting between myself and Senator Gorman, and tbe proposition itself is utterly absurd.

I realize and recognise that tbe recent election in North Carolina was positively adverse to my party, and it Is my duty to defer to tbe verdict ot tbe election. If anything further were needed to show tbe absence of fonndation of fact in this story It is found in the second article of the twenty-fifth section of tbe constitution of North Carolina which says: 'The terms for office for senators snd members of tbe boose of representatives shall commence at tbe time of tbeir elec Consequently it is the new Populist legislature and not tbe defunct Democrat, ic legislature that would convene if an extra session were ordered. This article was construed and sus tained by tbe Supreme court ol the State in tbe case of Aberholt vs. McKee, re ported in the sixty-fourth North Caro lina reports. "Ibat, said Mr.Kansom, is sufficient to show the absurdity of the story.
