Henry Diekerson, a white section laborer, was shot and instantly killed here Friday afternoon, Feb. 8th. by Jim Harris, a half-witted boy. For over a year a crowd of small boys had been guying Harris about falling from a train he had gotten on to ride to the section, and seeing that he was easy to tease, they kept after him every time he came to town. Finally some men took it up.

There is a crowd of "hahgers-bn" that daily congregate at Wood's store and who are generally tanked up on mean corn whiskey, and Diekerson was one of the leaders. They were having a hilarious time teasing the boy, who, becoming exasperated, told Diekerson to shut up, whereupon Diekerson commenced to curse and1 abuse Harris, applying a very vile name to him and threatening to kill him with a weight. Harris was finally put out of the store and went and got his gun and was passing by Wood's store when Diekerson came to the door and cursed him and slamming the door went back into the' Harris turned and walked back to the window arid State of North Carolina. Diekerson leaves a wife and three small children. Harris is an orphan boy, raised by Mr. W. B. Pierce, a farmer near here.

He is about 22 years old. It is generally conceded that the boy had been teased and abused beyond endurance, and being not too Drignt, puonc seniimeni is it i his favor. In fact, ninety-nine men out of every hundred would have done the same thing. Harris was immediately arres-; 3 i Leu. ciiiu.

15, 1907. Mr. Speaker Justice may want to be Attorney General of the State, but wanting a thing and getting it are two different things and Mr. Justice will find it out when he gets in the race. Durham County can no longer say she has never had a hanging.

Two paid the death penalty there, last Friday, One for killing his wife and the other burglary. Both men confessed as to committing the crimes and gave whiskey as the cause. There were forty-five new lawyers turned loose upon the State by the Supreme Court last week. It looks as if we might eventually get aplenty of lawyers, but to these young men we would suggest that there is a plenty of room at the top of the ladder. The time is coming, and coming rapidly, when people -are going to rise up in their might and overthrow "government by professional politicians." The people have had enough of this kind of government and they are not going to stand for it forever.

Such government is an inimical to the rights of a free people as "government by injunction." LTHFIELD HERALD. Then you said something, my brother. The Caarlotte Observer, always sensible, says it doss not care a rap whether it has a railroad pass or not, but it resents the meddling on the part of the Legislature in a matter that concerns only the railroads and the newspapers. This is precisely the objection of this anti-pass proposition. For one we do not thank the members of the General Assembly who propose to appoint themselves our moral guardians.

Charity and Children. The bill introduced at the beginning of the session of the Legislature to require all lobbyist to register was finally given the death blow last Saturday. We are not surprised at the defeat of this bill, for from this distance it looks very much like Mr. Speaker Justice is about the big-gest lobbyist in the Legislature and of course occuping the position he does he would not like to be put down in a public book as such. Judge C.

C. Lyon, of the Bventh District, is presiding at our court this week. His charge to the grand jury Monday morning was plain and to the point. He did not enter into a very long charge, but called their attention to a few of the important matters to come before them as a body. The rulings and conduct of Judge Lyon this week have made a very favorable impression upon our people.

Judge Lyon served as solicitor of his district a number of years and he thoroughly understands how to keep the business of the court moving. From the Grave. A prominent manufacturer, Win. M. Fertwell, of Lucamu.

G. Green and the State by solicitor J. H. Kerr. After hearing the witnesses for the State it was agreed that the evidence was not sufficient to convict of murder in the first degree and council for the defendant said they were willing to submit to a vervict in the second degree and the State accepted and thus the case came to a sudden ending.

Judge Lyon sentenced Johnson to the penitentiary for a term of fifteen years. Court adjourned yesterday evening. It will probably be an item of news to most of our readers to know that a postmaster is not compelled to make change for you when you make purchases at Uncle Sam's office. This is a queer rule that not one in a thousand persons know. Buyers of stamps or any purchases at a post office must furnish their own change; the postmaster could insist on the buyer furnishing his own change if he sees fit to do it; but usually the postmaster is glad enough to get rid of his "chicken feed," and he is always ready and willing to ac-commodate th6 public by making all the change it asks for.

If a man wishes to buy fifty cents worth of stamps and has but a silver dollar, he would be compelled to buy a dollar's worth of stamps or go and get his silver dollar changed or do without his stamps if, the postmaster was stubborn and refused to make change for him. This is the law and a queer one according to our way of thinking. And post-masters are not compelled to take more than twenty-five pennies at one time if they do not want them. Ex.
