NW Sec 29-13-4 117 WASHINGTON (UPI) - The Justice Department is turning over to Special Watergate Prosecutor Archibald Cox files on a closed investigation involving a firm owned by President Nixon's friend, Rob ert H. Abplanalp. v Rep. Bertram L. Podell, D- N.Y., said Justice Department officials two years ago over ruled a staff recommendation for an investigation of pricing practices by the firm, the Precision Valve Corp of Yonkers, N.Y. Podell said there appeared to be a "gross conflict of interest" between the Justice Department and the firm. Replying to this, Assistant Attorney General Thomas E. Kauper said Monday that records showed there was a disagreement on the staff level whether an investigation should be pursued. "The record shows that then Deputy Assistant Attorney General Walker B. Comegys considered the staff memoranda and arguments therein, was persuaded by the staff arguments against continuing the investigation and decided that an investigation was not warranted and should be closed," Kauper said. He said there was no evidence that the case ever was discussed by then Attorney General John N. Mitchell. Podell said he had documents relating to the case which he would turn over to Cox. The Justice Department said it would give Cox its records on the matter. Precision Valve was founded by Abplanalp after he perfected the aerosol valve for spray cans 24 years ago. The multimillionaire frequently has entertained the President at his home in the Bahamas. He helped Nixon buy his San Clemente, Calif., home Watergate affair as any witness likely to be heard by the Senate committee. He has denied previous testimony that he approved the Watergate burglary, but while being questioned Monday in a closed meeting with the committee staff, he acknowledged for the first time knowing of the cover-up which took shape shortly after the June 17, 1972, arrest of the Watergate burglars, committee sources said. As the hearing opened some 15 minutes late, with Chairman Sam J. Ervin, D-N.C, absent, William G. Hundley, one of Mitchell's lawyers, put on the record the fact that Mitchell was testifying only because he could be held in contempt of Congress for refusing. He has not sought or been granted immunity and is under indict ment in New York in a case growing out of a $200,000 cash contribution to Nixon's cam paign. Funeral Delays Ervin Dash quickly turned to the intelligence plan designed by Thomas Charles Huston, former leader of the Young Americans for Freedom, a conservative group, while Huston was on the White House staff. The plan called for break-ins as well as monitoring telephone calls and secretly opening mail before it was delivered as part of a stcpped-up drive against militants. Ervin, who was delayed reaching Washington after attending the funeral of his sister- in-law in North Carolina Monday, has said the plan would be "a great shock to the American people" if all the details were known. Mitchell testified that he opposed the plan from the start. "I needed very little convincing that this was not the proper approach to the problems of that time and I joined Mr Galetburg, 111. He said he did not know who specifically in the White House gave the go-ahead for the plan despite his and Hoover's opposition. Nixon, in a 4,000-word statement issued May 22, disclosed that the plan was drawn up. But he said it was withdrawn after five days, following Hoover's opposition. One police officer estimated there were twice as many spectators lined up outside the hearing room for the Mitchell appearance as the number that came to hear former White House counsel John W. Dean. Jokes With Reporters Mitchell looked a bit thinner than his Justice Department days but was dapper in a blue suit with a tliin red stripe, white shirt and a blue tie. Asked by reporters whether he did not want his wife behind him for support, Mitchell quipped: "I don't mind her supporting me. But I don't think she can make any money here." Asked if he was uncomfortable in the witness chair, he said, "I'm not particularly enamored 1 of the situation." Mitchell insisted that lie had only taken a leave of absence and had not severed relations with his law firm in New York He appeared a bit upset at the question. "I've just taken a leave of absence —to take care of some of my problems," he said. Mitchell was questioned Mon day by Senate investigators before appearing before the open hearing today. (UPI) Julie Nixon Eisenhower said Monday that President Nixon talked about resigning because of the Watergate scandal with his family, but did not discuss the subject with the White House staff. Her statement apparently was in reply to deputy press secretary Gerald Warren, who said last week "there may have been discussion within the family but that does not in my view indicate serious consideration of resigning." "My father did not discuss his resignation with any of the staff members. It was only discussed among the family," Mrs. Eisenhower said. (UPI) The amount of radiation received in the United States rom the Communist Chinese nuclear weapons test several weeks ago was too low to detect, the Atomic Energy Commission said Monday. China detonated a device with a yield of one to three megatons — up to three million tons of TNT -and the AEC since then has kept an eye on a high altitude air mass moving toward this country from the test area. The mass has passed over the United States, and readings at monitoring stations were "within the range of natural background" radiation — the ever-present radiation produced from natural sources, the AEC said.
