"Elders must be masters at the Internet," Dallaire said at the 17th World Congress of Gerontology.

"You will be relevant to the younger generation and you will be relevant to a cause," Dallaire said of the elderly at a symposium that also featured speakers from Switzerland. The symposium was part of the week-long conference that has drawn INQUIRY Continued from page: 1 McCaffrey represents Michelle Zillinger, an inspector with the Ministry of Environment in Owen Sound. She found ongoing problems with the Walkerton waterworks in 1998 but her supervisor rejected her recommendation to take legal action. Among other things, inquiry lawyers allege Zillinger didn't thoroughly check the water records. Had she done so, she might have realized that former manager Stan Koebel had falsified them.

McCaffrey calls the allegations "cockamamie." hetr "It is an abuse of process, of power, to send out a frivolous notice," says McCaffrey, who wants the judge to quash Zillinger's. Inquiry lawyer Brian Gover firmly rejects the criticism. "We've adopted the fairest possible procedure," says Gover. "The notices are given in order to secure procedural rights." Those rights include cross-examining witnesses and making submissions to O'Connor. Other recipients will be watching closely to see how the Ontario Appeal Court justice rules.

Privately, however, several of their lawyers, speaking on condition of anonymity, question Zillinger's strategy. "Why draw attention to yourself?" says one, who describes Zillinger as the "Mother Teresa" of the ministry's Owen Sound office. "Her best argument is that she did a good job." But Brian Barrie, who is filing a similar motion for another ministry employee, says he understands why Zillinger doesn't want to wait for 0'- Connor's report. "Once the horse is out of the barn, what are you going to do?" says Barrie. "(Recipients) are tarnished forever." Still, several lawyers say they doubt O'Connor will be inclined to quash the notices.

"If he grants the motion, then he's inviting 100 other people to bring the same motion," one says. One legal definition of misconduct is morally reprehensible behaviour, or deliberate and negligent breach of established rules. Both Barrie and McCaffrey, who concedes O'Connor has run the inquiry "awfully well," argue nothing their clients did falls into that category. They want to hear what his definition is. Moreover, they say, nothing their clients did could possibly have caused the tragedy that left seven dead and 2,300 ill from tainted tap water.

Gover understands people hate facing criticism for what might seem trivial reasons. But he says O'Connor, who is apprised of the issued notices, needs the freedom to comment on how everyone involved in the tragedy, directly or indirectly, conducted themselves. "This is not a criminal negligence causing death trial," he stresses. 4,000 policy-makers, non-governmental organizations and seniors' groups from 80 countries to Vancouver.
