EVENING STANDARD 14 WEDNESDAY 23 NOVEMBER 1994 is STANDARD REPORTER A UNIVERSITY student who had sex with a college girl despite her complaints that she was too tired to make love was cleared of rape today David Warren 19 wept in the dock at Winchester Crown Court as a judge ordered a Jury to find him not guilty of the charge Warren had denied raping the 18-year-old after meeting her outside the Kiss nightclub in Southsea Hampshire The couple went back to a house and Warren started kissing and cuddling the girl when they shared a double bed She told the jury that Warren had intercourse with her even though she complained she was too tired But she admitted that she did not fight off his advances and after he had sex with her slept with him for the rest of the night Only after discussing what had happened with friends the next day did she call in the police Judge Michael Addison directed the jury to acquit Portsmouth University student Warren at the end of the prosecution case He said: is up to the prosecution to prove that the victim was not consenting to sexual intercourse It is my view that the prosecution has failed were both in the same bed and whether she objected or not she did not tell him to get out She did not physically resist or make it plain that she did not want intercourse her own evidence she admitted she did not resist The first time she said she was too tired was when he tried to penetrate her did not try to stop him because she said she was shocked and confUsed and maybe had had too much to drink He could only go on the signs he was getting from her agreed she did not physically resist and there was some evidence that she said no but this was at a late stage and not in the most emphatic terms" He told the jury may think drink had a part to play If a girl is so drunk and in such a position not to say yes or no and a man takes advantage then it is rape In this case the defendant had no reason to know how much drink had been taken" Warren of
