May 1. 1893. The estate consists of $250 in personal property and about $8,000 In realty. The heirs are the widow, Sarah Louise Dutcher, of Alameda, Addle Belle Norton, a daughter, residing also in Alameda. The Will is olographic and bequeaths all the estate to the widow.

The closing paragraphjruns as follows; "Now. the reason I hav made no provision for our darling daughters, Mrs. Ad-die Belle Horton, nee Dutcher, and Elsie Louise Dutcher is that I am fully satisfied that my wife will do what Is right and just by them. Merritt The appointment of la guardian for the children of James P.

Merritt by Judge Sweeney of Shasta, with Instructions to commence suit to determine what rights, if any, the children (had in the Knowies Trust raised a doubt as to the legality of the transfers. This doubt is set at rest by Judge Ellsworth's decision. whkrh in effect confirms the legality cf the conveyances made 'by the Mer-rltts.
