TO GO Makes a Bold Bluff at Meeting of At the meeting of the City Council last evening the water-rate question again came up. i About 8:30 o'clock Mr. Mott the Council take a recess for one hour "and go into Committee of the Whole to consider the resolution fixing the water rates." Cuvellier seconded this motion, which was carried, with Schaffer voicing the only dissenting vote. Mr. Upton was chosen chairman of the Committee of' the' Whole, and Acting Clerk Holland announced that the only business to come before the committee was the resolution fixing the water rate.

The chair asked, "What'll you gentlemen?" and' then there was a lull. But soon Mr. Meese broke the Ice. "If no one else "will speak, I'll move the resolution fixing the water rates be recommended to the Council for adoption." Mr. Mott promptly seconded it.

Mr. Johnson asked whether the temporary injunction Issued by Judge Hart restraining the Council from fixing the rates had been raised. The chairman re-piled that it had not. GIRARD'S AWFUL DARE. "There's so much been said about that Injunction," shouted Mr.

Girard. "Why. everybody knows we are a judicial body and no court or judge has a right to upset the constitution. A prominent lawyer told me today that the constitution says we must fix the rates. "I DON'T CARE IF JUDGE HART FINES ME $500 AND PUTS ME IN JAIL FOR FIVE DAYS, I AM GOING TO VOTE FOR THAT RESOLUTION TO FIX THB RATES: IF THE ORDINANCE IS NOT LEGAL, WHY THE WATER COMPANY HAS A FINE CHANCE TO TAKE IT INTO COURT.

I would be willing to go to jail and pay 7my fine." CUVELLIER FLOPS AGAIN. "I suppose any one who keeps silent will be accused of having cold feet," said Cuvelliar. "Well, I want to say that I'll never be a party to any violation of an Injunction issued by a court, but I do not consider the recommending of this resolution a violation. I will never vote to pass it, though, during this Council, until the injunction is raised and I don't care who likes It." This Councilman then desired to read to the Council, fothe first time, the order of Injunction to eee what it really means. But Mr.

Taylor's objections riled him and he threw the court's order down remarking, "Well then, there, if you're going to apply the gag rule, I'm ready to vote right now." "Don't get excited, Charley," remarked Girard. "Yes, I will," replied the riled member. "These objections and Interruptions stir your liver." But he became becalmed soon and read it and then turned to City. Attorney Dow, who in answer to a question said: "In my idea you would not violate the in IS Bon and Boyer Not Permitted to Take Official Seats. Notwithstanding there were two vacant chairs in the old City Council last night.

Messrs. Stetson and Lemmon having come to the conclusion that their term of office-has expired, so it was whispered in the crowded lobby, the dilatory aggregation, like unto a mutual admiration society, again denied its successors to take seats. The old Council assumed iofflce on March 21, 1839, and as was clearly; pointed out by Attorney At, A. It wouldappear to a casual observer that the old Council that has ever been courting the stern hand of litigation until the.

city treasury is bankrupt, is now courting a writ bf mandamus and in prison for contempt, that their names might go down in history as these of "water When the Council was rapped to order last evening, and after Acting Clerk Holland had called the roll, ex-Mayor M. C. Chapman arose in the lobby and in unmistakable calmness, addressing the Council, said: "Mr. Chairman and Gentlemen of the Council; I now demand, on behalf of Charles A. Bon and Robert Boyer, two gentlemen at the polls a Councilmen, that they be permitted to take their seats and participate in the deliber ations of this honorable body.

They have duly qualified and are ready and willing to begin their duties." Without seeking any further legal advice as to -the status of Attorney Chapman's formal demand, Mr. Mteae, who has been succeeded by Mr. 'Boyer by a neat majority, clung tightly to bis cnair and said in a brusk tone of voice: "1 move we proceed with the' regular business." There was no second, but the unusual silence that followed prompted President Barstow to order, "ProceeiV Mr. Clerk And the Council then proceeded and passed an ordinance appropriating over $14,000 from 'the almost bankrupt city treasury with which to pay the extrbltant fees cf certain men who were called to testify as experts in the water rate THEIR DEMAND DENIED (: i SLOTJpiE Strong Test! The te3t case that of John Murray, a Washington street cigar dealer. charged with operating a gambling device and conducting a banking game- was decided by a jury of nine late yes terday afternoon Sri the Police Court in favor of the accused The jury 4 took only a few ballots arid stood eight for acquittal and one for conviction, the one being an attorney, who on the last ballot was wen oef By its verdict the' juryecided that the nickel-in-the-stot machine is not a banking game. The Murray case was the strongest of the eleven cases on the court docket in pj)int of evidence, for it was shown that; omcers cox ana Boyce, who had rlropped their nickelp in Murray's machine, won nothing by the spots on the turned-up cards, and were refused cigars in return for the guarantee of monby played. It is hardly likjely, therefore, that any of the other cases will be pressed to trial, and the naachines may be now be operated without interference by thepolice, provided the guarantee clause of dollar far dollar in cigars is adhered to. Lin phurch appeared for the defendant.

YACHT CASCO NOW SAILS THE NORTHERN SEAS. News of the long absent schooner Cas co comes from Seattle. At that place a man named John Graham arrived and detailed a terrible experience which he had in the Bristol bay district. Graham with Martin Pease tof Olympia, Thomas Williams, and two others named re spectively Bowmaii and Patch, left Nome August last Jn the Casco-. After an 880-mile trip and while out of sight of land they took a -small boat and start ed for Iliama A storm sprang up and the party was wrecked.

They spent the winter on the shore on which they were cast and wjeria finally rescued. The Casco ws Built and originally owned by the late Dr. Samuel Merritt of this city. She was then used entirely for pleasure purposes isn the part of the owner and his friends. She made several voyages to the Islands, of the Pacific and these always afforded pleasure to the owner, who was generally, abroad as also to his appreciative guests.

The boat changed owners a number of years ago, and the reference made to her in the information from Seattle is the first that has been heard of the craft for a number of) years.
