In the act'ion of Jones against Mul laney the Sheriff was called upon the otiher day to place the plaintiff in "pos session of a piece of property in Em-ervville occupied by the defendant.

When a Deputy Sheriff visited Mrs. Mullaney and told her -that -her effects must be removed, she gave her consent to the proceeding, but requested that the articles be placed In a vacant lot across the street from where she had beert residing. She said she owned the latter property. The Deputy, Sheriff accordingly granted her request. Jones 'has now made a protest against the storing of Mrs.

Mullaney's effects oh the vacant lot claiming that the property Is owned by him. He says hat the -writ of ejectment was not properly complied with, as Mrs Mullaney's effects -were merely removed from one piece of property owned by him to another. He asked the Sheriff to remove the personal property from the vacant lot, but his request was refused. A similar re quest made to Constable Weidler was also refused. Jones has heen aavisea to secure another writ, If he-wishes to have M.rs.

Mullaney's property re moved from the vacant lot, as the Sheriff annot determine which claim ant to the lot is the real owner. Nye Kinsell represent Jones.
