The matter of allowing the Oakland Transit to abandon Us tracks on certain portions of Park avenue and F.at Twelfth Street was again before the Street Railroad Committee of the City 'ouncil last evening and the ordinance granting the necessary permission was rei omraenilftl for passage with the understanding that the ordinance granting the franchise on San, Pablo avenue be so amended that the compay would be compelkd to run Us cars to First street instead of stopping at Seventh street, as in the past. asked -whether the company was not continuing its cars to First street and Ruch answered that it was only during certain portions of the day. "There are many meX-hanics," said Schaff er, "employed In the ship yards and along the water front. It is a great hardship for them to pay a second tare or even to transfer at Seventn street. It should be stipulated that the cars be continued to F.rst street before thev are allowed to aban don anv of their tracks. The petition of the East Oakland Improvement Club asking for the removal i of car tracks to the center of Commerce street was l-til over for a report from City Engineer Turner. i CURTAIN STORE JUST OPENED A new departure has been made In business circles which will toe appreciated by people who delight in beautifully furnished homes. It is the "Curtain Store," which has taken the spacious salesroom in the Athenian Club Building at the northwest corner of fourteenth and Franklin streets, across the street from the First Presbyterian Church. The proprietors are Plummer Peyton.

They are manufacturers and importers of draperies, curtains, rugs, window brass, shades, etc. They are adepts in the business. V- Plummer was formerly of V. J. Sloane San Francisco, and late manager of Taft 4s Pennoyer's drapery department.

14. With the beginning of the fifth day only sixteen teams were competing in the six day-walking match. The pace set by the leading teams has told on many of the men and early today two more teams-English and Biisack and Twvhey and Lawj'n declared themselves out of the irace. The Hurt brothers were off the track for two hours this morning. For the past two hours the English team has teen making up lost ground rapidly.

They exhausted by their exertions and both retired to rest at the ame time. The leaders are 125 miles ahead of the old record. FLANIGAN PLEADS HOT GUILTY. Edward Flanigan, who shot and killed Richard Gorman, who was trying to disarm 'him at O'Brien's grocery store in West Oakland, on the night of January 6th last, was arraigned before Superior Judge Melvin this morning. Flanigan pleaded not guilty to the charge of manslaughter and his trial was et for April 14th.

-a BAR ASSOCIATION HOLDS A MEETING. The Alameda County Bar Association met at noon today with Superior Judge Ogden in the chair and adopted the amendments to the constitution recommended by the special committee composed cf Attorneys W. H. Waste, L. S.

Church and Z. N. Golclsrby. Hereafter anyone living in Alameda county, who has been admitted to practice before the Supreme Courtmay join the Association. Formerly only Oakland ppractitioners were eligible.

Another important change is that of fees. The $15 initiation tee was reduced to and the monthly of fifty cents were abolished. Instead of the dues an assessment of mayjw levied by vote of the Association. It Is the purpose of the Association to give a series of banquets during the year. 'QUIET RESTORED IN KENTUCKY MOUNTAINS.

MIDDLES BORO, Feb. 14. fjuiet has been restured in the neighborhood of Lee Turner's House" three and a half miles from this' city, where the fight occurred Wednesday between the Middlesboro officers and Turner's mountaineers. According to the latest rerwts, the list of the dead comprises Charles S. Cecil.

Deputy Sheriff. Frank Johnson, Mike Walsh, Joseph P. Rader and Per-rv. Watson of Turner's forces. Tom Russell, a Turner man, is missing.

No attempt has been made to capture Iee Turner. He is at Bancroft, Tennessee, surrounded by his friends and is believed that a demand for his surrender would result in another battle. 14. When the House met today It was agreed that when It adjourned today it be to meet on Monday next. Mr. Payne, the floor leader of tbe majority, gave notice that on Monday would "call up the bill for the re- peal of the war revenue taxes. This being pension day, the House then went into Committee on the Whole and took up the consideration of private pension bills on the calendar.

In a very happy frame of mind after five anxious days at the bedside of his boy, who has been, critically ill with pneumonia at Groton, Massachusetts.

The journey back to the seat of government was made much more leisurely than the hasty dash Into New England last Sunday when the President's anxiety to reach his son outran the fastest special train. The trip to Groton was made in fourteen' hours but eighteen hours were consumed lin the return and in this home coming: the President had a chance to make three short rear car speeches to the at Worcester Woonsocket and Providence. In each he assured the waiting thai "Ted" wa all risrhrand out of the woods and in each case the crowd seemed as joyous as the President and cheered "vociferously. The journey af ter leaving Providence was uneventful Miss Alice Roosevelt will leave for Groton over the Pennsylvania road at 4:50 o'clock this afternoon. It is ex pected that if the improvement in thi young man's condition continues for another week he will be brought herj at that time.

She brought advices from Hawaii, under date of February 7th as follows: Subscriptions irt 'Honolulu for the- Me-Kinley Memorial Fund have been started by a local firm with a donation of $1,000. It is expected will be raised for the establishment of a McKinley Park with monument in some center loca tion. A mass meeting will be held tomorrow evening in Honolulu under the auspices of the Republican Territorial Central Committee to protest against the bill in troduced in Congress by Hawaiian Iele gate Wilcox, providing that the Island of Molokal shall be used for a national leper settlement. At present only a small part of the island, which is. half a day's jour ney from Honolulu, is used for a leper settlement, and there 'is a general pro test throughout the islands against having the territory advertised as a nationa Lazaretto.
