to a finish The citizens town were very much surprised Wednesday morning when they awoke to the fact that the Cumberland telephone office was closed and there was no service at all Perhaps never before has the populace realized what the telephone was until suddenly deprived of It and espe dally when there was a wellequip ped exchange in touch with the business houses and homes but with no operators to answer calls The two suits against the company one filed by individuals collectively for recovery of overcharges and one by the city of HIckman to compel the company to charge no more than the franchise rates or get out of town came up In the Circuit court at Fulton Tuesday the court having been too busy here last week to pass upon it The company failed to answer to the suit filed by the city which practically admits that they have a franchise In HIckman This they have bitterly denied In the Individual suit they filed two demurrers one of them demurring against the petition asking that the company be forced to charge the rates provided for hi the franchise which the court overruled The other demurred against the Individuals collectively filing a suit for recovery of rentals and to this the court withheld its decision until Wednesday Judge Bugg stated that he was of the opinion that they could file the suit thus but was not sure and would withhold the ruling until later The result was that Wednesday morning telephone office was closed to the public and no service was given all day Wednesday The Ilown was cut off from all communication both local and long dls the benefit ef these readers who are not acquainted with the situation and the oause of the troubles we wilt briefly state the facts When Mao Moore fermer manager of the company was checked out of the office by the Auditor the question arose as te why there were discriminative rates In effect in Hlokman The matter was ex plained to him and when he return ed to the Nashville office he reported the facts Then the present manager Mr Owens was notified to take those Instruments out which called for less than the companys standard rates and replace them with long distance instruments and at the same time put all telephones upon an ejjual basis This ef course did not suit the eighteen individuals torthat was the number effected by the order and a petition was circulated and signed by the majority of the subscribers of the telephone company setting forth the statement that they would not pay any more than the franchise rates This when submitted te the general manager of the company resulted in a conference and telephone meeting between the repre sentatives of the company and a number of the representative citl Jens in which considerable interest was shown The telephone representatives stated that they did not have a franchise in Hickman and that they could not be compelled to charge a lesser rate than they were doing and that before they would attempt to do so they would remove the exchange from the city The suits which had been filed were however unaffected by this meeting as the citizens were determined to win out Another meeting was held one night this week and a course decided upon There was some opposition to the determination on the part of the leaders but a vote was taken and the majority ruled that the suits be carried on Dr Davidson Is In Fulton
