court on the 3rd day of February 1905 asking that an order be made directing that an election be held in the city of Cor bin on the 4th day of April 1905 and that in said order the proper ffiocers be directed to open a poll at each voting precinct in said cityof Corbin on said date lor the purpose of taking the sense of the legal voters dfsaid citywho are qualified to vote at elections for county officers upon the proposition whether or not spir ituons vinous or malt liquors shall liu Soll bartered or loaned in said city of Iorbin and this proceeding having been continued at the rehru ir ary term 1905 of said court and this 4 being the next regular term of said i 2J in 4S 110 Im court thereafter and this proceeding i having come on for hearing upon the question as to whether or not this court shall make such order and it appearing to the satisfantion of the court from evidence heard in open court that Corbin is now and has been ever since the 25th day of March 11904an incorporated city of the fifth class situated partly in Whitley County Kentucky and partly in Knox County Kentucky and that thegreaterportion of the inhabitants of said city reside in the part thereof which is situated in Whitlcy County Kentucky and that the greater portion of said city is situated in Whit ley County Kentucky and that prior to said 25th day of March 1904 Corbid was an incorporated town of the sixth class and at the time ct the last election therein included the same territory and had the same boundrv as the present city of Corbin and that the last election held in the town of Corbin was held at the regular November election 1903 so that no election has been held in the city of orbin since the said 25th dav of March 90and that there is now and has been ever since the said 25th day of March 1904 a voting precinct in that part of the city of Cor bin which is situated in Whitley County Kentucky and that there is now and has been ever since said 25 day of March 1904 a voting precinct in that part of said citywhich is situated in Knox County Ken tucky and at the time of the last election in the town of orbin there was a voting precinct in that part of said town which was situated in Wliitlcy County Kentucky and that there was also at the same time a voting precinct in that part of said town which was situated in Knox County Kentucky and that the signature of each of the persons to said petition is genuine and that each of the petitioners whose name is followed by the word Whitley resided on the said ird day of February 1905 in that part of Corbin which is situated in Whitley County Kentucky and was then a legal and qualified voter therein and that sail petitioners were equal io number to 25 percent of the votes cast at the last eke tion held in the town of Corbin in the part thereof which was situated in Whitley County Kentucky and that each of the petitioners whose name is followed by the word Knox resided on the said 3rd day of Feb ruary 1905 making entries ill the orderbook in relation to this proceeding It is now ordered by the court that nn election be held in thsaid city of Cot bin on the said 4th day of April 1905 for the purpose of taking the sense of the legal voters of said city who are qualified to vote at elections for county officers upon the proposition whether or not spirituous vinous or malt liquors shall be sold bartered or loaned in said city of Corbin and the Sheriff of Whitley County is ordered to open a poll in that part of said city of Corbin sit tinted in Whitley Count at tlc vot ing place therein upon
