The decisions Tuesday turned back attempts by civil libertarians and an avowed atheist to stop public instruction in religious songs and the biblical code of ethics. Appeals are likely. "It is like playing overtime. Nobody likes to let it stand that way," said Kentucky Civil Liberties Union attorney William C. Stone after the state's high court deadlocked 3-3 to uphold a law allowing the posting of the Ten Commandments in classrooms.

In the South Dakota case, a federal appeals court cautioning that its decision would not apply in all cases ruled against a parent's attempt to have religious songs banned from Christmas programs in Sioux Falls public schools. Roger Florey, an avowed a i touched off a statewide furor in 1978 when he complained about the use of the hymn "Silent Night" in his son's kindergarten Christmas program. He contended the use of the song violated the doctrine of separation of church and stale. However, the 8th U.S. Circuit Court of Appeals in St.

Louis upheld the Sioux Falls board of education policy allowing religious songs for instructional and educational purposes. The appeals court said the policy was not promulgated with religious purposes in mind. "We view the thrust of these rules to be the advancement of the students' knowledge of society's a a religious heritage, as well as the provision of an opportunity for students to perform a full range of music, poetry, and the court ruled. At the same time, the judges said, the opinion was limited to the policy upheld in 1978 by U.S. District Judge Andrew Bogue.

(AP) Police say a Los Angeles couple is being held today in the Greene County Jail in connection i an alleged kidnapping of an Oklahoma City woman. Missouri authorities said no charges had been filed against the couple who were arrested Tuesday after the young woman who said she was kidnapped in Oklahoma City slipped away at a Joplin service station.

An FBI spokesman, John Warren, said charges were pending until after the young woman was questioned by Oklahoma City authorities. Joplin police Sgt. Richard Schurman said the young woman identified as 18-year- old Deloris McDowell of a a i told authorities she was forced into Jerry Lehman of Dawn, at left, president of the Livingston County Pork Producers, con- gra'jlates and presents a plaque to Jack Dedrick of the Chillicothe Live Stock Market 100 per cent cooperation in the National Pork Producers' Council's pork checkoff program. The NPPC with its 97,000 members in 35 states is the largest commodity organization in the nation. Monies collected through the voluntary deduction programs are shared by the NPPC, state pork organization and the National Livestock and Meat Board.

In turn, these organizations help to organize research and educational programs, promote consumer relations and government relations, and, most important, Lehman said, provide advertising and pork promotions. Lehman said the Livingston County Pork Producers have received the national Gold Star Award for membership growth in 1980. "Many thanks to Dale Whiteside and his crew for the fantastic job in signing up new members," added Lehman. --Constitution-Tribune Photo School Christmas carols win round in court the American Civil Liberties Union to appeal and added he would keep his son, Justin, home from school on the days Christmas programs are rehearsed. a rare tie vote by the Kentucky Supreme Court, made possible when a former state attorney general disqualified himself, left intact a 1979 ruling by Circuit Judge Squire Williams Jr.

that a state law permitting display of the commandments is constitutional. "Basically, the Ten Commandments is a code of conduct which just happens to be rooted in Judeo-Christian history," said Justice Boyce Clayton. Argued Justice Robert Lukowsky: "It is an inescapable conclusion that the Ten Commandments are a religious creed." Stone, who represented five Louisville-area residents who challenged the law, said an appeal to the U.S. Supreme Court was likely. Earlier this year, a U.S.

District judge in North Dakota declared unconstitutional a 1927 state, law mandating the display of the commandments. The decision has not been appealed. Assistant North Dakota Attorney General Murray Sagsveen said he believed that state and Kentucky were the only two with such laws. a car in Oklahoma City late Monday night and forced to drive. Schurman said they stopped at a service station in Joplin Tuesday morning where "she told the people who kidnapped her that she had to go to the bathroom.

She told the service station attendant that she had been kidnapped, and he called police." The couple left in the car and headed east toward Springield before police arrived. The Highway Patrol said the couple was spotted about two hours later near Springfield, about 100 miles away, traveling at least 90 miles an hour. Sgt. Jim i of the Highway Patrol said they were stopped about 12 miles east of Springfield near the Greene-Webster county line. They were not armed.
