Tho case was then taken to the late Court of Appeals, which ourt took no action in the case until October last whan they rendered a decision affirming the Judgment of the lower court, and Robertson was resentenoed by Judge of the County Court, to be hange.1 on the 21st iay of December, but was respited by Governur O'Ferrall until the 25th day of January. An effort was made In the mean time to secure a petition to the Governor asking for commutation of Robertson's sentence to life Imprisonment; but as both the Judge and tho Commonwealth's Attorney, G.
