Treaty With Swiss: Some Help By NORMS WIlitiATT i London financial Times-tJPI LUGANO -The United States and Switzerland in May signed a treaty of roeijffocal aid In penal matters. It covers mutual assistance in detecting and punishing crimes of all kinds but the main interest lies in the special section dealing with organized crime. It is in this connection that the Swiss banks' veil of secrecy will be able to be raised. Ones the treaty has been ratified, American law enforcement officials will bo able to go to the Swiss and, provided they have sufficient evidence , to indicate criminal activities, oblige a bank to open its books, tfave Final Say Tn faxst, the Swiss authorities will not have to comply with a request for aid, and they will have the final say as to whether or not secrecy shall be penetrated in any specific c&'ie. If only they could get proof of this, argued the Americans they would then at least be able to seek conviction* on income tax fraud. Clean Hands On the other hand, compliance for the Swiss required a number of adjustments, and the reconciling of various points of view. The Swiss have always claimed that their hands are clean, that bankers turn down foreign money if they have reason to believe it is tainted. One of the main causes of friction has been dliferenccs in legal interpretations. For example, in dwltaerlaftd it is not a criminal offense to evade taxes. Hence, to break the secrecy barrier just to help secure a conviction for tax fraud would, in Swiss eyes, by unjustifiable. Under the treaty, It will be permitted, only when evasion is involved with crime. The Swiss have also succeeded in obtaining certain other safeguards Which they considered vitally i imiportant. Everything depends of course, on how the new regulations apply in practice. Inasmuch as they will mainly be concerned with the exchange of Information, such as legalized documents, sworn testimony, notification of judiciary proceedings, evidence as to the whereabouts of persons, things ought to go smoothly enough. Problems would only be likely to arise over the issue of jurisdiction, especially Where national sovereignty ffltgiti be involved. in the final analysis, the Americans have got essentially what they wanted, and the Swiss have given away as little as they could. The Americans will now be able to pry behind the secrecy curtain for the evidence they are sure exists, and which will help them bring their own criminals to book. O.T.
