The City Court. Early Monday morning of last week, as Dr. Gardner had bean exceedingly annoyed by the pigs of his ucighbor George Austin over-running his garden, poking their nose into his kitchen door, and so on, he saw George milking and thought he would speak to him and see i if he would not keep them up. George had seen the Doctor throwing sticks and 'tones at his pigs, and had probably mentally vowed revenge, and when the Doctor showed himself, took him by the throat, and after ctioking him and kicking him until tired, told the Doctor to gti home or he would do worse. A warrant for Mr.

Austin's arrest was applied for, but the Mayor'eotild not immediately be found, and it was obtained bclore 'Squire John, before whom a trial was had by jury, resulting in a fine of $2o and costs, which swelled it up to some thing like $40. The attorney for the defendant availed himself of the great imperishable writ of habeas corjntf, and had him brought before Judge Kelley, who decided that tlte trial of an oilVuse against a city ordinance before a Justice ol the Peace was illegal and void. The defendant, upon advice of his attorney, appeared before the Mayor and plead guilty, and was fined ten dollars, thus apparently stopping prosecution. It seems this has been the uniform mode of actimi under such circumstances, and therefore there can be no blame in the least attach to the present Mayor, for following in the foot-teps of his prcde- although we understand Judge Kellev has stated it to be his opinion that a voluntary pleading of guilty does not bar prosecution. The complainant let the ttler rest as it was, claiming, however, that his right to prosecute still c.ited.

An authoritative deci-ion in the matter is much needed by out-city authorities, as the practice of pleading guilty before a Mayor's court might, in certain contingencies, defeat the emls of justice to a degree not contemplated. A Correction. a simple act of justice, we make the following statement in reference to the affair at Uoseudale in which K. T. Iteckett and Mrs Conway figured as actors.
