Kids stay free in Super, Deli Man Hit by Gunman By Mark Lowery and Alison Carper A Harlem building superintendent and a deli manager were shot and critically injured yesterday allegedly by a man who sought revenge after the superintendent broke up a fistflght between the gunman and another man, police and witnesses said. The alleged gunman, Gregory Gilliam, was arrested minutes after the shooting and charged with two counts of attempted murder, police said. Witnesses and police gave this account of the shooting: A fight between Gilliam and smother man broke out about 9 a.m.

yesterday in front of 301 W. 154th Street, near the comer of Eighth Avenue. The building superintendent, George Gentry, 44, broke up the fight. Gilliam left and returned at 9:30 sum. with a handgun and just as Gentry opened the door to let an electrician inside Gilliam opened fire from the sidewalk, police said.

Gentry was shot twice in the face, once in the right shoulder and once in the right thigh. The electrician was not injured. Gilliam then ran inside the Uptown Super Deli a half-block away, Btarted waving his gun and shot Armed Nasser, 31, the manager, in the abdomen, said Charles Possey, a deli employee. Both victims were listed in critical condition in Harlem Hospital yesterday. Officers from the 32nd Precinct, patrolling Eighth Avenue, saw Gilliam flee the deli and arrested him one block away, at 153rd Street, police said.

Gilliam, 29, of 305 W. 149th Street, has eight previous convictions, including robbery, assault and weapons possession, police said. Fire Atop CitySpire Is Declared Arson By Michael Moss A fire that roared through the penthouses atop the 72-story CitySpire building in Manhattan two weeks ago, jamming elevators and sending firefighters scrambling up 48 floors, has been ruled arson by city fire investigators. Investigators determined that construction trash was intentionally ignited to cause the fire in the building at 150 W. 56th Assistant Fire Commissioner John Mulligan said yesterday.

The case remains open. CitySpire stirred one of the citys biggest land use wars in recent years when its owner Ian Bruce Eichner used various loopholes in dty zoning restrictions to build 14 feet higher than his permit allowed. Over the protests of community groups, the Board of Estimate this spring narrowly approved a dty Planning Commission deal that allowed Eichner to keep the extra feet if he built a dance studio. The blaze was the latest in a series which have beset buildings owned by the Eichner family. Eichner blamed labor troubles for the May 22 blaze, which iryured one firefighter and damaged the towers top three floors, where triplex penthouses are being built for Eichner and buyers.

When youre finishing the construction, sometimes you have problems, said Eichners attorney, Howard Homstein. City officials and other building experts said labor troubled resulting in arson were quite rare. Jobs usually go quite smoothly. Wildcat actions are far and few between, City Buildings Department Commissioner Charles Smith Jr. said through a spokesman.

Two months ago, a blaze broke out in a building in Columbia Heights in Brooklyn, developed by Eichners younger brother, Jonathan, who now lives in it. Investigators determined that the blaze, which injured 26 firefighters, was not suspicious. On Feb. 1, 1980, a fire gutted the 10-story Margaret Hotel on Orange Street in Columbia Heights, which Eichner was renovating to sell as co-ops. The cause of that blaze, which injured seven firefighters and damaged two fire trucks, was never determined because the building was too badly damaged to inspect, a dty fire spokesman said yesterday.

Homstein said an insurance claim would be filed on the CitySpire fire, which broke out on the 69th floor and cut off the elevators that descend to the 24th floor. The injured firefighter fell in a stairway.
