A-10 Santa Cruz Sentinel Thursday, Aug. 4, 1988 Obituaries House VOteS 41 3-3 I Vital statistics BIRTHS FUNERALS BJRTHS to impeach judge The impeachment proceedings stemmed from a 1981 oharge that Hastings conspired with a Washington lawyer to take a bribe in exchange for reducing the sentence of two convicted racketeers. Afterward, the judges of the U.S. Court of Appeals for the llth Circuit began a separate investigation that took nearly four years and concluded Hastings was guilty and had won acquittal through perjury. The Judiciary Conference of the United States last year forwarded the panel's report to the House with a recommendation that "consideration of impeachment may be warranted." Among the 17 impeachment articles is one that charges Hastings with disclosing confidential information from a federal wiretap he was supervising.

Rep. Joseph D. Early, a Massachusetts Democrat who voted "present" on the impeachment, said he did so because Hastings had been acquitted by a jury. But Rep. Peter Rodino, the chairman of the House Judiciary Committee, responded, "The fact that Judge Hastings was acquitted of the bribery charge does not alter our responsibility to adopt articles of impeachment based on the extensive record of his corrupt conduct." The vote was particularly painful for Rep.

John Conyers the chairman of the Judiciary subcommittee, who is also black. Conyers said he began the investigation believing that perhaps this was a case of harassment or outright racism. The New York Times WASHINGTON The House of Representatives voted overwhelmingly Wednesday to impeach Federal District Judge AJcee L. Hastings for 17 high crimes and misdemeanors. The charges involve conspiracy to accept a bribe, perjury and improper disclosures of confidential information.

The vote of 413 to 3. with four others voting "present," puts the matter before the Senate, which must try Hastings on the charges. A two-thirds vote of the Senate is required to convict the 51-year-old jurist and remove him from the bench of the U.S. District Court for the Southern District of Florida. Hastings is the 11th judge to be impeached by the House in more than 200 years.

Hastings was appointed in 1978 as the first black federal judge in Florida, and he has said racial motivations were behind the impeachment proceedings, initiated more than 15 months ago, and preceeding criminal charges of bribery' made in 1981. But in the debate of Wednesday, House members said the Judiciary Subcommittee on Criminal Justice compiled strong, compelling evidence against the judge during its investigation. "This is a very unpleasant job that none of us has relished at all," said Rep. Don Edwards, a California Democrat who serves on the subcommittee. "One thing that Judge Hastings can be assured of is that he got due process." WOODS July IS at 4.20 pm.

Kennedy, introduced a $20 billion-a year program Wednesday to provide long-term health care for the elderly, chronically ill and disabled. "This is a costly measure, but it is even more costly for society not to deal with it," Kennedy said at a news conference. He said the cost to society was forcing families to "pauperize themselves" to pay nursing home bills. Kennedy said he did not expect that Congress would approve the bill this term, with the end of the session near, but that he wanted to start debate on it, particularly among the presidential candidates. Long-term health care could become an important campaign issue, given the voting strength of the elderly.

Mark Goodin, a spokesman for Vice President George Bush, who is to receive the Republican presidential nomination this month, said he could not comment on the Kennedy proposal because he had not yet MIDAS MUFFLER BRAKE 318-C RIVER ST. Michael S. Dukakis, the Democratic candidate, did not respond to a request for comment. Kennedy said he favored financing his program, which he labeled "Lifecare," by increasing the ceiling on the Social Security payroll tax base from $45,000 to $75,000 a year. He said alternative sources were inheritance taxes and higher taxes on alcohol and tobacco, but he opposed increasing the deficit. The bill differs from both the program to insure against catastrophic illnesses, passed by Congress earlier this year and a bill providing for long-term health care in the home, introduced by Rep.

Claude D. Pepper, D-Fla. Under the first part of the bill, the full cost of home care and the first six months of nursing home care would be covered by the government.
