But Judge Thornton pushed his investigation to show that iho admissions mudo were given upon promises of protection or fear of a mob. and there was a long light over the legality of such evidence. The contest took tho same ground that wns gone over yesterday, when tbe defense attempted to have Swick's testimony excluded, Judge Phillips took the same view as on yesterday, aud allowed tho testimony to go to the jury. Heinloin then continued his testimony, aud said that when Swick told Montgomery that there were a number of scratches and cuts en Miss Bond's neck, and that dem- enti's finger had been bitten.

He (Montgomery) exclaimed: "My God what shall I do!" Tho witness then detailed the conversation between himself, Swick aud Montgomery. Swick toKl the accused that if bo knew anything he ought to give it away, so that be and Pettus could put it on to dementi, and suggested that bo send for Lee Pettua Montgomery usked if he would be protected if he kiievr anything and it away, and after some further converg satioa sent for Le) Just, about that time Montgomery was ar rested by a constable and taken to Taylorvillo. Witness did not see him until a few days afterward, when he was in jail. He then said he had Clementi. "He is all solid," said Montgomery, "and has given nothingaway." Witness also detail ed a conversation with Montgomery in Grove City after his release from jail.

Returni to the school house witness said ha found a pool of blood on the floor, just beneath the scuttle bole. This was in corroboration of Miss Bond's statement yesterday, that in attempting to get up she foil and caused her nose to bleed. Witness stated that he picked up some hair just beneath the edge of the platform in the school house loft, but was not then permitted to exhibit it in court. Part of this hair wan twelve inches or more long and a part of it wae sbort. Court sdjonrned until afternoon.
