STANISLAUS COUNTY NEWS They Wear Like Iron Taken Under Advisement a The proa and cons of the contention for the dissolution of the Modesto Irrigation District was heard by Attorney-General Fitzgerald at San Francisco last Saturday At the conclusion the Attorney-General took the matter under advisement The action ie entitled McKimmon et al vs Modesto Irrigation District and the bearing Saturday was to decide whether the action ehonld be started in the name of the State against the district Those opposed to irrigation under the Wright system favored the name of the 8tate to the action while those in favor of upholding tbe law were unfavorable to such action Those who appeared before the Attorney-General were Frank A CreBaey 0 Tilleon Abbott Theodore Tomer Davis and George Perley as witnesses The attorneys were Eastin of this city and Judge Van Patterson of San Francisco for McKimmon et al and Chickering Thompson Gregory for the district The decision of the Attorney-General will be given in a few days NEW INSOLVENCY METHODS No More Petitions in the Superior Court For eeveral months no ceies of insolvency have appeared on tbe book at tba County office Tbe cansa ia to be found in a United States lew which went into effect this yesr requiring all insolvency proceedings to be brought in Federal Court The fact is not generally known thpt insolvency cases have been taken out of the Superior Courts entirely and that all the proceedings must now be bad before a United States Referee in Bankruptcy But this has been tht caee since the beinning of last August As yet no petition has been filed in this county under the new order of things Under the new law the Reieree makes bis report to one ot the Superior Judges who signs the order of adjudication Tbs creditors are entitled to a representative in the proceedings who is called tba Trustee in Bankruptcy The object ot the new method of procedure is to protect the interests of creditors living in other States Under the revised order of things it would be possible for a person to go through insolvency without attracting much attention in his home community because tbe petition can be fildd in any county ot the State he rainfall for the present storm up to 8 this morning at Oakdale was 47 of an inch Last week the fall at that place was 70 of an inch On Thursday last the six-year-old son of Mr and Mrs Angelo Basso died at La Grange and the funeral took place on Saturday last at 2 The boy was a bright one and the parents are heart broken over his Iosb Husband Turner have a very choice line of goods suitable for the holidays which are displayed so that all may make a selection from them They have a new advertisement in this issue setting forth tbe fact and the stock should be seen to be appreciated Tulloch has decided to erect bis flour mill at Oakdale on tbe west side of the railroad track adjoining hay warehouse on the north instead of on tbe eaet side near the cemetery as was first contemplated We are informed that the main building is to be of wood three stories in height Oakdale Leader Prof Holway of the State Normal school at San Jose is one of the instructors and lecturers now attending the Stanislaus County Institute Prof Holway was formerly principal of the Modesto public schools and was one of the best educators that this city ever had He was alike popular with the pupils aud parents He is being cordially greeted by his many old-time friends The weather still remains favorable for the farmer and this morning 02 of an inch was registered as last fall Today the clouds were thick and by noon slight showers began to fall and at 3 this afternoon 17 of an inch bad been added making a total of 49 for the Btorm and 202 for the season The prediction of the San Francisco weather bureau sent out this morning is for light showers tonight and tomorrow The present storm is very light on the west side of the San Joaquin river and the Grange guage at Landing reported a fall of but 09 of an inch up to this morniug A FORTUNE AT STAKE The ricDougald Estate Tlay Yet Prove to Be a Rich One It will be some time before tbe axact statue of the eBtate of the late McDougald will be known A decision is shortly to be rendered in the United States District Court which will result in either the loss or gain to the estate ot $190000 As is very well known in business circles Mr McDougald held bonds on the great Turlock irrigation system to tbe value of $190000 These he took in payment for carrying out the contract which virtually built the system For eeveral years the interest on these bonds was paid bnt the conflicting legal questions growing out of the Wright law under which the irrigation district was organized raised a question as to the validity of the bonds and the landowners refused to pay tbe interest After various efforts to straighten out the matter and securing a favorable bnt ineffective decision Mr McDougald with other bondholders brought suit to compel the payment of tbe intereet Upon the decision this matter the validity of the bonds will be decided If the court orders tbe payment of the interest it will establish the standing of the bonds and give tbe holders recourse to foreclose in case of default on interest principal or tbe amount of the judgment Attorneys who have looked into the matter believe that there is no question but that tiis decision must be favorable to the bondholders Ii this Bhould be the case Mr estate will be in fine condition The appraisement gives but little insight into its value unless the expected decision has been rendered on the bonds This may come within the next two Stockton Mail CHRISTMAS OBSERVANCES How the flodesto Sunday Schools Will Entertain the Children This is the season ol the year when the Sunday school children are on tbe qui vivo ot expectancy at what Santa Claus will bring them for Cbiistmas In conformity with the time-honored custom most of tbe Sunday schools will have suitable observances ol the occasion At the Methodist Church there will be Christmas tree The representation of a house and the chimney from which Santa Claus will descend fo show himself and distribute the presents to all wilt be a special feature and will be one of the handsomest representations that there has been in this city The original Santa Claus will be there and will add much to the mystery and edification of the good little boys and girls A fine programme oi suitable literary aud musical exercises will precede the distribution The exercises will commence at 7 :30 this evening At the Christian Chnrch there will be an excellent programme of exercises and the presentation of the Christmas giftB to the children will form an attractive and beautiful representation of something entirely new in this city The nature of it will not he made public as the Sunday school teachers have determined to surprise the little ones The exercises will be held this evening and will commence at 7 30 At the Presbyterian Church there will not be a tree or gifts distributed but a very attractive literary aud musical pro gramme will be presented there this evening On the Sunday evening follow lug there will be Christmas exercises in tke church which will be participated by the members of the Sunday school At the Methodist Church South there will be no Christmas exercises bnt on F'riday evening of next week there will be a party given at the church the memlters of the Sunday school only It will be made an occasion that will make up for theontission of the regular Christmas tree A Railroad Suryey 1) Griffiths Civil Engineer has been in Modesto for the past few days purchasing mules for a railroad surveying party which will start out In a abort time in Southern California He put chased sixteen mules and they will be shipped to San Bernardino county The mules will he used for tho transportation of the men and for hauling etc the desert lu that part of the State The survey to be made is for a railroad lilt like all railroad engineers Mr Grif-ths is reticent ns to the points to be closed or as to the employing company From the place of the ourvey however may be surmised that it is lor (he Hanta re railroad company which proposes to close the gap between the Santa Fe and their recently acquired purchase the controlling intereet in the Valley Railway The surveying crew will consist of twenty-two men and letter received by the Board of Supervisors from Mrs Nusbaum of Sacramento Further than that the latter showed that the writer was of a diseased mind no one hare seemed to know anything about her The last issue of the Sacramento Sunday News aives the following account of her which shows that she is very industriously engaged in plying her vocation of writing insane epistles The News says of her "Mrs Nusbaum and her husband have been furnishing considerable annoyance to many persons both here and and in neighboring communities The couple are far past aoeridan and are worth something like $75000 in worldly goods They are ardent believers in spiritualism and take the rules of their daily life from that inspiration Whether they are led to do the strange things attributed to them through the machinations of false or through their own mental weakness is not known but Chief Dwyer says that he intends to ascertain the fact through the medium of the machinery Mrs Nusbaum is the correspondent of the house and has been mailing all kinds of quter demands to Boards of Supervisors other officials and private persons Her vagary is the imaginary possession of real estate and money in every direction and her letters are filled with religious ejaculations interspersed with demands for the visionary belongings Among those who have received eplBtles from her is Frank Miller of the Mills Bank About a year ago the Nua-bauma worn arrested for threats against the life ol a Mrs Thesis They wars released upon bonds and deposited $1000 in tho Mills Bank to guarantee their peacefulness prominent Chinese merchants baB informed us that Modesto has a lot of boys from the ages of 10 to 15 who frequent Chinatown and coax and beg for tobacco opium and other articles which they should not have The Chinese merchant is much adverse to having the boys get any of the articles but he feels that the parents of such boys should keeg them away from Chinatown and save the Chinese the annoyance of refusing them the articles which if given them would result in their becoming opium smokers It seems strange that such a request should come from tbe Chinese as a person would naturally feel that tbe Chinese who uphold the practice of opium smoking would encourage the practice rather than call attention to tbe fact that the boys go there A Narrow Escape Mrs Ford of North precinct narrowly escaped a horrible death on Saturday December 10th Her husband who had been a cripple for many years had started in a buggy in company with bis wife to Oakdale When the aged coople proceeded about a mile from their home the clothing of Mrs Ford was discovered to be on Are The morning being cold a hot brick bad been placed in the bottom of the buggy Tbe lady in her fright jumped from the buggy and ran beyond the reach of her husband he being unable to pursue her However he finally induced his wife to return and succeeded in tearing off the flaming clothing but not until the unfortunate woman was severely burned At last accounts the injuries were not believed to be Oakdale Leader Building and Loan Commissioner Governor Budd on Monday last appointed McCabe formerly of this city Building and Loan Commissioner for this State The salary attached to tbe office is $2400 per annum Mr McCabe waB formerly County Clerk of this county and at the time of the taking of office by Governor Budd he was appointed Executive Secretary and later was elected State Librarian but the Board which elected him were subsequently declared an illegal body and a new board selected Hon Frank Combe of Napa in bit stead Since hit retiring from that position he has practiced his profession of law at Sacramento The appointment is made to fill an unexpired term and Mr McCabe will serve two years and a half Death of A Root Tuesday morning at Oakland A Root one of Stanielaus well known farmers died Death occurred at about 8 The cause of death was not obtainable In this city today He was a native of New York aged 72 years Tbe funeral took piece from the residence on Oak street Oakland yesterday at 11 30 a Deceased leaves a widow and three grown children Mr Root had large land in tereate in this county and resided here until a few years ago aud since that time he and his family have spent portion of their time at the home ranch a few miles east of this city He was a noble-hearted honest upright man and poaseised the esteem and confidence of all Confidence Man Conies to Orlef James Rodgers was the name given by a man who started out to play the confidence game on a number on Tuesday evening At tbe afterwards fell into the clutches ol Davis who locked him up for vagrancy The man is well enough dressed to deceive people and took advange of it Orange Stealing Many Modestoans have a lot of orange trees in their homes The trees are both ornamental and at this season ol the year when the fruit is ripe the sight is a pretty one but nearly all who have orange trees casks complaints of tbe depredations of boys Usually they are not content with taking few but tree! ere literally stripped of tbe frnit end in many instances tbe trees ere broken down There ie no excuse for the thefts end it tailor-made salt while the groom wore a conventional black suit A splendid dinner was served after congratulations had been served and amid a shower of rice the happy conple departed tor their home at the residence ot the groom's mother on the southern outskirts of this city The bride is the daughter of Mr and Mrs Walthall and was raised in this city and ia a pretty and attractive young lady who has endeared herseli to a large circle of friends The groom is the only eon ol Mrs A Brinckerhoff and is a gentleman ol quiet habits and of good buii ness qualifications The happy young couple were tbe recipients of a large number of handsome wedding presents in silver and glassware The Nxws ex tends congratulations upon the wedding ot the two popular young people Case Postponed LaBt Friday was the time set for the trial of 8 charged with asaieting a prisoner to escape from the county jail Tha Diutriot Attorney stated that it had been impossible to locate the whereabouts of John Flint one of the principal witnesses and desired to have the evidence as given by him to the grand jury read to the jury This was objected to by tbe counsel for the defendant and the case waa then continued until the first Monday In March next Flint ia the person whom it is alleged purchased the saws with which Phillips sawed his way out of jail He is a farm hand and np to a recent date waa in tbe vicinity of Escalon San Joaquin county Friday morning the name ol RKIt-trell ol Fresno was entered ol record as one of the attorneys for the defendant Nearly Asphyxiated Julrus Stiefvater was nearly asphyxiated on Wednesday of last week by the gas from a oil lamp was turned too high He woke at 4 :30 and lit a lamp so that he would not oversleep himself but being partially asleep dropped offintoaslumber before the lamp light fully blazed op and when the alarm clock sounded the 6:30 hour he was just able to get out and break out a pane of glaeB to get fresh air The noise attracted the attention of the other mem1 bers of the household and he waB lazen out into fresh air The room was fall ol soot and the gas waa stiflling It was a narrow escape and had the alarm clock not aroused him he leela that he growtlt ol a person His criticisims and pointed remarks brought on the first discussion ol the session The afternoon session of the Teachers' Institute was called to order Tuesday at 1 30 The teachers were favored with vooal solos by Miss Rose Vogt and Blacker Alter roll call the teachers received another lesson from Mrs Robertson on "Physical Prof llolway in his usual entertaining and instructive
