After a short visit he went away. He get word later from his sister that it would be better for him not to come there, but that they would meet at his father's home. Craig never went back. Tills word was sent btm on the Saturday before the tragedy, which happened the following Monday. The first time that he saw Mikel it was said, was when be saw him come out of the barn.

That Craig grabbed him and said, "Get up AL get up." That Craig ran down the street crying, "Where's a doo-tor." The Provocation.

Mr. Gillespie further stated that Craig was born and reared in the vicinity of Downs. That in the spring of 1114 when twenty years of age, lie worked for Cbauncey Adams, who rented a forty from A. C. Mikel.

Packard reported to the board that be is busy preparing the plan and estimate for the iiroposed creosote, or wood block pavemenut on East Grove street It will be recalled that a few weeks ago, the property owners of East Grove street petitioned for a new pavement and made tho specific request that it be a creosote block pavement The board is now preparing to give the putitioners the kind of a pavement they desire. The defendant, Floyd Craig, sat I' Just behind his council and toos: an active interest In the questioning of the talesmen, giving advice to his ntfm-novn and answering their ques tions regarding the qualifications oj tho taking of some homes to Bloomington and some mules to Downs. The quarrel was over one Item of the bill. But that Mikel finally paid the bill amounting to $11 and went away and never spoke to the defendant again until the Saturday previous to the tragedy. Three Witnesses Called. Two witnesses were called by the state before closing time.

A. Bell, county surveyor, took the stand and testified to bating made plats of the scene of the quarrel. F. It. Cole, a mail carrier, who was standing across the street from the alley and saw the whole affair.

He said he saw an object fail and ran to the alley. He saw Craig stoop down and turn Mikel partly over and heard him exclaim, "Al get up." He said Mikel's feet were to the south and his head lying to the west Rev. H. E. Long-brake was next called.

He was standing with some other men about twenty feet south of the alley. He heard an unusual noise and with the others ran to the scene. He helped carry the then dying man to McConnell's garage and saw him breath his last there. The trial of this case Is expected to take until Friday. The veniremen have been excused until Friday morning at o'clock, which is an Indication of the length of the present trial.

A man by the name of Lantx was standing at the door according to the statement of Mr. Young.

As Mr. Mikel reached the middle of the alleyway, Craig Is said to have accosted hlra. saying "If you hav anything to say about me, say It to my face and say It to me now." Mikel is said to have replied, "What's the matter. Let me alone." MIkol set the buckets down and backed up. CTalg followed.

Mikel motioned him to go away and by this time had backed west toward the street about twenty feet. He then turned and ran the remainder of the distance until he reached the street sidewalk. He turned, and when in this position Craig is said to have struck him. He fell, his head striking the concrete sidewalk and never moved. But one blow was struck.

Statement of Defense. Attorney Frank Gillespie In his opening remarks to the Jury stated that Floyd Craig was employed in the garage of Mr. McConnell and was mending an inner tube of an automobile when he first saw Mikel that day. He stated that Craig knew nothing of his brother-in-law's presence until be lookt up and saw him standing in the doorway of the garage. Mikel is said to have called Craig there a name, which was spoken in the court room, but which cannot be printed here, then he turned and went awav.
