plastic sia geon who placed a computer with private patient record in his trash On Tuesday Johnson County District Court two patients of Daniel Bortnick filed a class-action lawsuit against the physician and Ms practice Monarch Plastic Sts-gery The lawsuit seeks unspecified damages for negigence invasion of privacy and breach of fiduciary duty The lawsuit says that Borinick's and Monarch's conduct "constitutes an outrage is beyond the bounds of what persons should have to tolerate in avil society and has caused the plaintiffs extreme emotional distress embarrass merit and humiliation" Neither Bortnick nor his attorneys could be reached for comment Tuesday Bortnick found himself at the middle of a legal maelstrom last month when KCTV Channel 5 obtained his patient records and began contacting the patients The station got the records from a scavenger who picked up the computer from the curb of Bort-nick's Mission Hills home retrieved the records from the computer and turned diem over to KCTV Bortnick then sought and obtained a restraining order against the station hairing it from contacting the patients or using the records The station has appealed the restraining order to the Kansas Supreme Court KCTV is urging the court to overturn the order on the ground that it is an unconstitutional prior restraint Although the restraining order remains in place on June 30 KCTV7 broadcast a story about Bortnkk's alleged carelessness in trashing the computer and interviewed a patient who was not identified by name The patient expressed dismay that records she assumed were confidential had been treated so carelessly In court documents Bortnick has said that he believed the computer's hard drive had been wiped clean He also said that he had removed the computer's random access memory to render it inoperable The plaintiffs in the lawsuit filed Tuesday are Riverside resident Kathy Jenne and Meriden Kan resident Michelle Grandmon tagne The two seeks damages on behalf of all similarly situated patients Neither could be reached for comment The lawsuit says it should be certified as a class action because all the patients share similar issues in common including whether Monarch and Bortnick had a duty to maintain the confidentiality of medical records under the Health Insurance Portability and Accountability Act of 1996 whether they had a system for maintaining the Kansas City North was accused of assaulting a worker at the General Nutrition store at Antioch Shopping Center in June 2004 according to day County Prosecutor Dan White Wilson could be sentenced to seven years in prison Sentencing is scheduled Sept 8 White said Court records showed that Wilson was charged twice in 1994 with lewd and lascivious behavior in lohnson County District Court He
