THE FRANK CASE. A very worthy movement, in our opinion, has been started in Fairbanks, the object of which is to induce the governor of Georgia to extend the clemency of his office to Leo M. Frank, former manager of an Atlanta pencil factory, who is facing death on the charge of having murdered Mary Phagan, one of the girl employes of the factory of which Frank was manager. Notwithstanding the fact that the sentiment against the convicted man is very strong in Georgia, the evidence Introduced during the trial and the disclosures which have "been made since then by those who have interested themselves in the case, encourage the belief that Frank is the victim of circumstantial evidence and the persecution of corrupt prosecutors whose star witnesses were men without standing in the i in which they reside. Conclusive evidence of his guilt was not produced i the trial and in the months that have elapsed since his con- Carl Hayden, Congressman- at-Large from Arizona, Is Personal Friend of Delegate and Mrs.

The trial had much more the appearance of railroading an innocent man into the hereafter for the sake of a conviction. The friends of the convicted man have exhausted every means at their disposal to prevent his execution, interested in the North to come to with the single exception of the appeal to the governor of Georgia which is now being made, not only by Frank's friends in the South, but by justice-loving Americans in every part of the i States. Dan Lehon, the New Orleans manager of the Burns Detective agency, who was associated with the great detective i the investigation, recently issued a statement in which he declared that "if the mandate of the law is carried out and Frank is executed, it will be a severe blow to the courts the whole country." "It is a sad state of affairs," he said further, "when a lineup of perjurers, i character or reputation, can go into a court of justice and swear away the life of a clean, honest, conscientious, upright and citizen like Leo a a man of stainless character, who has stood the acid test of some of the most able investigators and expert physicians in the United States, who fine-tooth- combed the cities of Atlanta and Brooklyn, the former home of Frank, and who investigated him from the cradle, and were a to i one bad mark against him, even during his boyhood days." The seed will not be planted in Fairbanks until next spring, but when the open season arrives the following fall, there will undoubtedly be a more plentiful supply of ducks.
