delaying project By JOHN DAUNER Mt Writer Wyandotte County District Attorney Nick Tomasic on Tuesday asked the Kansas Supreme Court to quickly decide the legal issues delaying development of the Kansas International Speedway The issues focusing on moving and relocation payments and the issuance and financing of bonds for the speedway were raised in a lawsuit filed by the owners of seven parcels in the project area Two parties are attempting to intervene in that case which is before District Judge Philip Sieve In his petition Tomasic told the Supreme Court that waiting for the litigation to work its way through the lower courts would jeopardize the project which he called economically important to the whole state The track operation is expected to put $1178 million into the economy each year raise state tax revenues $53 million annually and create 2455 jobs The district attorney and the Kansas attorney general are the only persons who can take a case directly to the Supreme Court For the purposes of taking the litigation to the Supreme Court Tomasic who strongly favors the speedway stands in the shoes of the plaintiffs who are challenging the legality of the Unified approach In a joint scheduling motion Tomasic and the Unified Government of Wyandotte County and Kansas City Kan the defendant in the case have told the court they will be ready to have the case heard and decided by Oct 19 This is the second time this year Tomasic has asked the high court to take a case relating to development of the speedway and quickly resolve the legal issues He filed a petition April 23 asking the Supreme Court to decide the constitutionality of legislation under which the speedway is being developed The Supreme Court upheld the laws on July 10 KANSAS Tuesday and it discharged when he put his book bag away in a kindergarten classroom a school official said Topeka School District spokesman Brad Stauffer said the gun went off with about 20 students in the classroom but nobody was injured Stauffer said authorities had not determined where the boy got the pistol which he said had been reported to police as stolen in 1995 Explosives scare: a glass vial filled with an unidentified liquid was found Tuesday morning taped to a wall in a rest room at the Sedgwick County Courthouse in Wichita prompting a short-lived scare A deputy discovered the vial scene Also on hand were a hazardous material response team and health department officials Officials have not identified the substance Abortion lawsuit An anonymous unmarried couple has sued abortion doctor George Tiller his Wichita clinic and one of his employees contending that Tiller and the employee told people that the couple had visited his clinic for an abortion The plaintiffs identified in court papers as John Doc and Jane Doe filed the lawsuit in Sedgwick County District Court against Tiller his Women Health Services clinic and employee Sarah Dennis Judge Keith Anderson heard arguments in the case Monday The attorney Jeffrey Emerson asked the court to keep Tiller Dennis and their attorneys from doing anything that would disclose his clients1 identities Defense attorney Bill Tinker
