said detectives house earlier in the day She said that shortly before hearing gunshots she saw Henry leave in a vehicle and that when she looked up she saw KJ standing over the victim taking his wallet Several witnesses including the mother of two young children identified Bolton as the man seen shooting Brees on a store security videotape on Dec 28 There is no tape of the second shooting but at least one witness identified Bolton as assailant from police photographs After the preliminary hearing a judge ordered Bolton to stand trial on the capital murder charge Because of defense allegations that evidence favorable to Bolton had beeh illegally withheld the judge also ordered that the entire police file be copied and that Gorman go through it and turn over all evidence identified someone other than Bolton as the shooter In an anonymous call to the TIPS Hotline on Dec 31 the woman said she had witnessed the shooting and knew the two men involved She said she knew the shooter only as Kevin or KJ and that he might be found at a house at 40th Street and Wood Avenue in Kansas City Kan She identified the other man as Marty Henry who lived in Columbia More than two months later on March 25 the woman came forward identified herself and gave Detective Roger Golubski a full statement It came out at preliminary hearing last week that police had failed to follow up aggressively on the information attorneys did not learn about the statement until May 8 four days before his May 12 preliminary hearing On May 6 prosecutors had told the attorneys that laboratory tests indicated separate guns had been used in the two homicides The woman testified at preliminary hearing and said that killer was the man she knew as Kevin or KJ and that he and Marty Henry had
