The Kansas City Star Thursday June 16 1994 Channel 62 sues the Royals BROOKS BROTHERS SEMI-ANNUAL TOMEWIBE SALE The contract creating The Baseball Network was announced in May 1993 two months after Channel 62 and the Royals signed a three-year deal that runs through 1995 The Baseball Network is to run for six years All teams share in profits the network generates The national contract will cause more damage than just the loss of the promotional benefits Channel 62 officials said Several stations on the Royals TV network have stopped carrying the games because they will be on other stations in their markets These former Royals stations include WOI-TV serving Des Moines and Ames Iowa KBSI-TV in Cape Girardeau Mo and KYOU-TV in Ottumwa Iowa In Kansas City Channels 4 and 9 are selling spots during Royals games for less than rates asked by Channel 62 the lawsuit said In addition the broadcast of the prime-time games on the other stations meant that Channel 62 had to carry more day games which get lower ratings and are less profitable to fulfill its commitment to broadcast 59 road games and four home games Banks said Channel lawsuit isn't likely to affect most major-league teams He said several teams are owned by the stations that carry them and others contract for a percentage of the profit generated by the broadcasts He estimated that only a half-dozen other teams are carried by stations that pay rights fees primarily for the promotional benefits the Royals he said Banks said Channel 62 sought the broadcast rights primarily to promote the station would accelerate the growth of the Banks said would draw viewers to the station For that reason we were willing to make an outright investment for the promotional MacDonald said he has tried without success for eight months to get the Royals to renegotiate Last November he offered three options Channel 62 would continue to produce the games and sell advertising and give the Royals 95 percent of the profit instead of paying a rights fee The Royals would get free air time and would produce the games and sell advertising and keep all of the profit The Royals could move their broadcasts to another station and end the agreement with Channel 62 The Royals rejected all three and made no counterproposals Banks said basically ignored me Their stubborn and absolute refusal to discuss this in a businesslike fashion has impacted the relationship" According to the suit the Royals eventually offered to give Channel 62 more tickets to give to advertisers and to reduce slightly the number of games the Royals require the station to carry thus modestly reducing the rights fee when we got into a discussion they retracted that Banks said Continued from A-1 have our legal counsel review it I said Dennis Cry-der vice president for administration Fans are not likely to miss a scheduled televised game Channel 62 will broadcast all Royals games it said it would carry until a court rules the station said It also will continue to pay the rights fee in its contract: about $37 million this year and about $4 million in 1995 In the suit filed in US District Court in Kansas Channel 62 said the Royals violated the contract by refusing to renegotiate after important conditions had changed have gone from being the exclusive home of the Royals to being one of three homes of the said Andrew Banks managing director of ABRY Communications which owns Channel 62 is like buying a house and finding out there are two other families already living said Jhn MacDonald Channel 62 general manager MacDonald said the contract with The Baseball Network is different from previous contracts between TV networks and Major League Baseball because it puts far more Royals games on other channels Last year for example the Royals appeared only once on CBS and a few times on ESPN That threaten Channel claim to be the exclusive home of 1 8 TO 50 REDUCTIONS BEGINS JUNE I6TH SPECIAL OFFER SHORT SLEEVE KNITS Assorted styles strike over Afrikaans-language instruc tion in which marching children were gunned down by South African police Hundreds of black youths died during several months of protests throughout the country The school shut down for three years afterward and classes were frequently disrupted by political unrest throughout the 1980s closing entirely in 1986 Now the austere classroom blocks are being renovated and biggest concern is getting more staff for the 1146 pupils There are 32 teachers about half with university degrees But the school lacks a full-time guidance counselor librarian or remedial teacher Experts agree that the black education system has been a shambles Last year more than six in 10 black youths failed their graduation exams and only 84 percent qualified to enter a
