6 T1IK feTAH noUTK CASKS Argument Upon the duration of Challenge It- ihe Defense The argument on tlio number of challciiRCR the defense wero entitled to in tlio star route trlnl was continued yesterday lcforo Judge Wyllo In tlio criminal court Tlio counsel on lioth sides and tho defendants with tho exception of Stephen Horsey were In attend nncc Tho jury wcro dismissed until 1 oclock Mr Wilson for tho defense said they hnd nothing to Bay thu court had onco decided the question of challenges Mr Merrick stated ho had motion to rnnko nnd would do so tit the proper time Mr Davidgo said his sldo hail no further motion to make In regard to tho argument on tho clmllenRcshc thought It entirely within the discretion of tho court to llx tho time and length Tho argument was for thu enlighten meut of the court Judgo Wyllo considered thcro could ho no better titno than tho present hut would re servo his decision until tho tlmo came for challenging tho jurors Mr Davidgo replied that this was a most important question whether each defendant should havo four challengers or whether there should only be four for the wholo of them The defendants wore on trial for their liberty and after tho argument tho decision should not bo withheld Thu court said they wero not entitled to a decision until tho proper tlmo came to de Mr llon followed Mr Davldge adopting thosamo lino of argument Ho contended thev proceeded as If tho law was settled on the lulins already made If they wero to go on in tho dark it would work great Injustice to their clients Therefore ho thought tho decision should bo rendered at the closo of the argument The court said counsel should not presume anything It was sullleicut for them to know when the court desired a rear nutrcnt tho court was undecided and on thii subject the mind of thu court was as a blank sheet of paper Mr IngcrMill asked if tho point was now argued that tho court would announce his decision before the first juror was called so that each side might know how they stood Judge Wvlio said this was a now trial and anv point of law that might aviso was open to argument although a ruling had been made lit the last trial Tho court bad given notice that it would hear reargument on tho question so that they would bo placed in the wnnn position now as they were at the former trial Mr IJavldge noted an exception as ho considered tho defendants wero entitled to know tho number of challenges they wero entitled to Tho court then directed tho argument to proceed Mr Merrick said ho would be brief In offering what suggestions ho had to make Ho thought tho whole question fell in a very narrow compass and was embraced by tho statutory law Ho cited section 819 Uuvlsed Statute whieli provides that in caso thcro are several defendants tho parties on eaeli sldo shall bo deemed a slnglo party for tho purposo of challenge Ho held this section was not Inapplicable to thoDlstilct of Columbia and cited the caso of Page and ilurusteln in support It was not for tho government to show that tho section was inapplicable but for the other side The provision in tho general statutes did not collide with tho local statutes Sineo tho last trial lie had made inquiry as to tho practice of the courtb on this subject and found that Judgo MacArthur and Judge Hagner had both held that section 8111 was good Mr Dnvlriero replied for tho defense Ho said tho law cited had only been passed in 1871 and seldom called upon Judges Hagner and MacArthur had ruled In support of it while Judges James and Wyllo had ruled a ainst it so tho weight of opinion was about equal Tho caso cited that of Pago nnd Burnstcin If properly applied put an end to ho pretensions of the government that tho cum was wrong in its decision at tho last iil Mr Davidgo then critically discussed tli various statutes their meaning and tho cider iu which they were passed At this point tho jurors wero excused until I lomlny morning and Mr Davidgo continued showing the application of tho statutes to this District and claiming that as this particular tccthm was only passed in 1872 it did not ionic under the organic act of 1871 providing that all laws not locally inapplicable Mere joia1 in this District That section intent the laws existing in 1871 Mr It Carpenter followed Ho referred to the policy of congTess in limiting the government as to challenges and baid that in Ibis case where tho department of justice with its learned nttorncys and spies and defectives without number nnd even tho presidential oltlco was thrown into tlio scale to gmid account furnished tho best illustration to congress to justify them in passing this law He held that the government were not entitled to any peremptory challenges but simply challenges for cause Mr Hcnklo followed on tho samo sldo with a brief speech Mr Merrick then commenced the closing ai giimcnf for tho government Ho maintained tiD applicability of the statute which he had cited lie would not notice tho Insinuations made against tlio powers of tho United States It would bo timo enough for that when tho case came to trial It would bo injudicious and unwise that tho United States should hare one nile in one judicial system and a difleient mm in another In reply to Mr Davidgos objection ho held that tho act of 1871 referred not to the constitution as it then existed but to the constitution as it now exists He thought tho court had held at tho last trial that the statutes were not inconsistent as the government had been allowed threo remptory cballengci Thieves should bo no safer in tho District of Columbia than in New Yoik At 305 Mr Merrick finished when tho court adjourned until Monday Judgo Wyllo reserving Ms ilrcision Among tho spectators present yesterday wero Mr Dickson a prominent patent lawyer of Xew York and ex City Solicitor David Sellers of Philadelphia Those lown Knr lllngs In consequence of ceitain published reports of unfair dealing In tho count of tho vote on tho diamond ear rings at tlio Jurfield monument fair a joint meeting of tho Iowa commissioner and ladles association connected with the Iowa booth was held Thursday evening nt tlio tho count and manner of voting was fairly conducted nnd that tlio successful candidate wasjustly entitled to the jewels Tho only points In disputo wero a few votes alleged to have been impropeily
