The case was continued till next term at tbe coats of bis client.

COMMON PLEAS. The trial list was then called over to ascertain what waa for trial. On calling State Bank vs. Neal McCoy, judgment by consent was entered iu favor of plaintiff for $271.12. This case was one that was tiled here three years sgo.

It grew out of a patent right transaction. About four years ago a patent right swindler visited this county with a patent bay fork, seeking, like Satan, "somebody to devout." Chance threw defeudaut in bis way. Tbe agent saw bia failing, ministered to it, and when be had got Neal perfectly oblivious, sold hiiu tbe right for $250, taking a promissory note for the same The note was sold to tbe State Bank, at.d was protested when due. Neal refused to pay it. Suit was brought eu it, tried, and verdict returned for defendant, the only defeuce to the note being drunkenness of the promisor.

It was taken to tbe Supreme Conrt and i reversed, that august tribunal laying it down a) a fixed priuciple of law hcre- after, that druukcuness does not avoid recpoosibilily. Hence the result iu the case now. In the case of John Thompson vs. David Smith, the plaiuiiff took a nonsuit. The case of Jonathan Burns vs.

Elias nydei, was coutioued by couseut. In tie ca-te of Jesse Ueed, Adm'r of Susan Graham vs. Samuel T. Diinui. by consent judgmeut was edtered io fivur of plaintiff for $3X0.

In the case of Win Given, Assignee of C. J. Chamberiiu, vs. ilber F. Mc' ahac, by consent judgment for plaintiff fir $34.28.

George M. Graham vs. Overseers of Poor of Turbett township. The history of this case is as follows In January, 1872, Joseph Tonsey, of Turbett township, waa attacked by small pox. One of the overseers, John McLaughlin, euipUjed Dr.

G. to attend tha case. He did so, paying Tousey some eight visits, being compelled at each visit to wash and change his clothes in an open stable, with tbe thermometer away below zero. He presented a bill for tbe same, of $150. The present overseers refused to pay it, deeming it exorbitant He Lad already been paid $50.

Some five doctors swore the bill was reasonable, and two swore it was exorbitant five swore tbat small pox was highly dangerous, and two that it waa not so much so as scArletina or measles. F. Crouse vs. John MeMaoigal. Replevin fur a horse. B.

F. Crouse owned a horse running in the stage line from Perry sville to I'oncord. lu Jan-nary last be sold tbe line, reserving tbis horse. He took tbe horse to defendant's hotel, in Perrytville. When be demanded the horse defendsnt re fused to deliver him up unless plaintiff paid bills charged against him amounting to some $G0.

Plaiutiff refused, alleging be d'd not owe that much. Defendant retained the horse and converted him to bis own use. Piff. leplevin-ed, but deft, gave bond and kept property! Ou trial plff fully proved ownership, when deft aet up plea of "lien." The Court decided that under deft's plea of property" generally, this pica could not be Plff then moved to amend his plea. Deft then alleged surprise, aud the ease went over to tbe next term at cost of plff.

John Shineloff vs. Exckiel Campbell. Action in Assumpsit. Tbe plaintiff's claim waa founded on a book account, got up in bis nsnal methodical manner. Tcft pleaded payment.

Bey was tbe constable of Susquehanna township, snd as such sold a tenant of Wei- ser's ont on an exemption execution. eiser claimed some of tbe money as rent on a landlord warrant. Bey re- fused to pay him ont of proceeds, hence' this suit, Verdict for plff for $18, under instructions of the Court, which held the matter open for the purpose of examiuiug into the law on several Cue points submitted, which uay yet change the judgment. Kichard Johnson vs. David Siui'h.

This was the case of the term, not only in importance but also as to the amount involved, the number of witueses in attendance, as well as the interest manifested in the iesuU. Johnson, the plaintiff, is a tenant on the farm of ohn Thompson, which adjoins the farm of the defendant from the canal across the pike np to the ridge. Deft, in November, 1872, without notice to plff, removed a division fence between the two farms, from the hue back upon bis own laud, thus throwing open field of plaintiff's which was weil set in wheat. Johnson, when he found it out. went aud made a fence on Thompson's land to close up the gap, which was at the pike.

Deft threw it down, or bad it thrown down sevtral times, in fcet, as often as it was rebuilt. In tbe meantime cattlo found the opening snd trespassed on the wheat, The plaiutiff brought this suit for the damages sustained to tbe wheat. He proved tbat in ISO! his laudlord aud Smith bad divided the fence between them, that the fence was on the hue, that Smith removed it eutireiy, aud then threw down and removed new fence put up on Thompson's own land by plff. Deft attempted to prove that no division of the fence bad takou place in 1864, that little if auy damage was done, and tbat while he, perhaps, bad committed a trespass, it was not done malicii usly. Tbe case was ably argued on Friday night aud Saturday uinrning, aod tho jury, after a fair charge Irom the Court, fouud a verdict for tbe plaintiff for $420.
